PORTLAND, Ore. — The U.S. Army Corps of Engineers is reviewing a modification of an application requesting a Department of the Army permit for certain work in waters of the United States. The public notice regarding the modification listed here was issued during the week of April 2, 2007.
Public Notice NWP-2007-135, requested by the United States Coast Guard. As described in the original public notice, the applicant proposes dredging up to 5,000 cubic yards of accumulated sediment from the access channel of their facility to the federal navigation channel. The original notice identified that the dredged materials would be disposed of at an upland disposal site or at an authorized in-water disposal site. Applicant now requests disposal of dredged materials at a designated ocean disposal site. Comments must be received by April 20, 2007. The Corps of Engineers is soliciting comments from the public, federal, state and local agencies, Indian Tribes and other interested parties on these permit requests.
The Corps of Engineers will issue or deny any permit under authority of Section 404 of the Clean Water Act, for discharge of dredged or fill material into U.S. waters, and/or under Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.
If the applicants have submitted a mitigation plan with the permit request, it will be considered. If a permit is issued, the Corps will decide on the appropriate and practicable compensatory mitigation for each proposed project.
