Construction Permit Fees

Who is covered?

Anyone that applies for an air pollution construction permit. In addition, anyone that undertakes construction without a construction permit that should have applied for an air pollution construction permit and paid construction permit feels is subject to these fees.

The fee is to be paid to the Agency at the time the construction permit application is submitted.

What is the fee?

The fee is effective for all applications submitted and is determined from the following schedule.

Types of Applications Subject Only To A Filing Fee

No fee will be assessed for a request to correct an issued permit that involves only an Agency error, provided the request is received within any deadline for a permit appeal to the Pollution Control Board.

How does the applicant determine the fee to be paid?

Applicants for a new or revised air pollution construction permit are required to submit a certification of the fees estimated to be due, accompanied by payment of such estimated permit fee, with each construction permit application submitted to the Agency.

The Agency has prepared a Construction Permit Fee Form (FEE-197) for applicants to use in calculating the proper fee, available from our Construction forms web page.

If the Agency determines at any time that a construction permit application is subject to an additional fee, the Agency will notify the applicant in writing of the amount due and the applicant has sixty (60) days to remit the assessed fees to the Agency.

What happens if the proper fee is not paid?

The Agency is not required to process, nor does the statutory time frame for the Agency to review an application begin to run, until the Agency receives the initial air pollution construction permit application fee and certified estimate of the required fee.

If the Agency determines at any time that a construction permit application is subject to an additional fee, and the proper fee established is not submitted within 60 days upon request for further remittance and the construction permit is not yet issued, the Agency is not required to further review or process the application, and the statutory time frame for issuing a permit is stayed until the proper fee is remitted.

If the proper fee has not been paid but the permit has already been issued, the Agency will notify the permittee and the permittee is given 60 days to remit the additional fee. If the permittee does not remit the additional fee within 60 days, upon written notice, the Agency may immediately revoke the construction permit.

In the event that a permittee issued a construction permit makes the fee payment from an account with insufficient funds, the Agency will notify the permittee. If the permittee does not pay the proper fee within 60 days of receipt of written notice, the Agency may, by written notice, immediately revoke the air pollution construction permit.

Does the applicant still have to pay the fee if the request for a permit is ultimately denied?

Yes. If the construction permit application is denied, the construction permit application fees are still owed by the applicant.

What if there is a dispute over the fee amount due?

The denial or revocation of a permit for failure to pay the construction permit fee is subject to review by the Board, pursuant to the provisions of subsection (a) of Section 40 of the Act.

Asbestos Fees

Who is covered?

Owners or operators filing the notifications required by the federal asbestos National Emission Standard for Hazardous Air Pollutants (NESHAP) are covered. These notifications are required to be filed 10 working days in advance of asbestos demolition or renovation projects subject to the federal NESHAP. The Illinois EPA has been delegated the authority to implement and enforce the asbestos NESHAP by the U.S. EPA, and currently receives all “10-day notifications,” inspects work sites for compliance with the asbestos NESHAP, responds to complaints regarding failure to comply with the asbestos NESHAP, and ensures proper remediation.

What is the fee?

Under the law, a fee of $150 per 10-day notification will be collected.

Non-Title V Operating Permit Fees

Who is covered?

This permit program covers sources in Illinois that are required by our federally approved State Implementation Plan to have operating permits but are not large enough to be required to obtain a permit under Title V of the federal Clean Air Act, known as the "Clean Air Act Permit Program" or "CAAPP" permit.

This fee impacts approximately 5,985 sources that have State air operating permits. Approximately 5,300 of these sources currently pay the minimum fee of $200. These sources typically include concrete batch plants, quarries, drycleaners, grain elevators and small printing and coating operations.

What is the fee?

The legislation sets the site fees based on the amount of emissions of any combination of regulated air pollutants as indicated below:

What about portable emission units?

The owners or operators of a portable emission unit (e.g., an emission unit on a chassis or skids and designed to be moveable, like a concrete mixing unit), as defined in the regulations of the Pollution Control Board at 35 Ill. Adm. Code 201.170, are not required to pay an additional site fee each time the unit is moved.

Special provisions for "avoided" permit fees

If an owner or operator of a site was required, but failed, to timely obtain an air pollution operating permit, and as a result avoided the payment of site fees, the Agency will collect double the amount that would have been owed had a permit been timely obtained.

Special provisions if fees are not paid

The Agency may revoke a permit for failure to pay the site fees.

Clean Air Title V Fees

Who is covered?

Sources that are subject to Illinois’ Title V permit program or CAPPP under Section 39.5 of the Environmental Protection Act.

What is the fee?

The site fees are based on the amount of emissions of any combination of regulated air pollutants as indicated below:

What is the significance of the fees?

CAAPP Permits limit the allowable emissions of sources in Scetion 5.0 of the permit. This is done to set the sources annual site fees, which are calculated from the sources allowable emissions. While these fee limits are NOT federally enforceable, these fee related limits on a sources allowable emissions are enforecable under state law.

When do I need to provide a fee form?

A 292 CAAPP fee form is required upon initial application and upon renewal application. A new fee form is also required when the source wishes to change their fee limits.

Land

Tire Sales Fees

Who is covered?

Each retailer that sells a new or used tire must collect a fee from the buyer and send that fee to the Department of Revenue, minus a handling amount of $0.10 per tire. The Department of Revenue has a form and system to keep records of tire sales and pay the fee.

What is the fee?

The fee is $2.50 per tire sold. Retailers keep $0.10 per tire.

Uniform Hazardous Waste Manifest Fees

Who is covered?

Every generator of special waste (hazardous or nonhazardous) who generates more than 100 kg (220 pounds) of special waste per month must use a uniform hazardous waste manifest for each shipment of waste released to a permitted transporter. The Uniform Hazardous Waste Manifest may be purchased from any USEPA-approved vendor, or from Illinois EPA.

Hazardous Waste Permit and Inspection Fees

Who is covered?

Facilities that generate, store, treat, incinerate or dispose of hazardous waste. Facilities that perform more than one category of waste handling only pay the highest applicable fee. Generators of hazardous waste that qualify as "Large Quantity Generators" are required to submit an annual or biennial hazardous waste report. Facilities that are storage or generators only, will submit their annual fee with their annual hazardous waste report. Facilities that are covered by other waste handling categories will continue to pay their annual fees in installments.

Landfill Tipping Fees

Who is covered?

Municipal waste landfill operators currently pay two fees (Solid Waste Tipping Fee and Subtitle D Fee) based on the volume of waste received each year.

What is the fee?

The fee depends on the total volume of waste received in a calendar year. Operators that receive more than 150,000 cubic yards of waste in a year have the option of measuring waste by volume (cubic yards) or weight (tons) and deciding which unit to use to calculate the fee payment. Operators that receive less than 150,000 cubic yards in a year fall into fee payment categories.

Potentially Infectious Medical Waste (PIMW) Fees

Who is covered?

Haulers who transport PIMW from doctors, dentists, veterinarians, hospitals, clinics, etc., must ship it in vehicles permitted by the Illinois EPA. Each load picked up must be accompanied by a PIMW manifest purchased by the Illinois EPA, and properly completed. The PIMW hauler must submit quarterly reports and payment of 3 cents per pound to Illinois EPA for each pound of PIMW disposed of or treated.

NPDES Permit Fees

Who is covered?

Holders of individual and general permits under the National Pollutant Discharge Elimination System (NPDES), other than for Concentrated Animal Feeding Operations, must pay an annual fee.

What is the fee?

Fees are based on a variety of factors such as the type of operation, the nature of the discharge and flow rate of the discharge. Specific classifications and fees are detailed below .

  1. For NPDES permits for publicly owned treatment works, other facilities which treat and discharge primarily domestic sewage, and discharges of wastewater from the operation of public water supply treatment facilities, the fee is:

Note: more than one of the annual fees may be applicable to a permit holder. These fees are in addition to any other fees required under this Act. Fees imposed under this section do not apply to the state or any department or agency of the state, nor to any school district.

Frequently Asked Questions

What should I do if I believe the fee amount is incorrect?

Contact the Division of Water Pollution Control permit section at (217) 782-0610. The law requires the Agency to assess interest on any past due fee amounts, but interest will not be assessed on fee amounts successfully disputed. Therefore, it is important to pay, prior to the due date, the fee amount you believe to be correct. If your dispute is not successful, interest will be charged on only the amount that was not paid by the due date.

I've received an invoice for a permit I can't identify. What should I do to determine if I have properly been billed?

Each invoice includes the specific permit identification number and was mailed to the party of record who applied for and received the permit. If your records do not include the permit referenced on the invoice, you may contact the Division of Water Pollution Control permit section at (217) 782-0610.

What if I overpay or underpay my fee amount?

Overpayments cannot be refunded but may be applied to future NPDES fee amounts due the Agency. Underpayments will result in an interest penalty being assessed on past due amounts. Failure to pay the fee in full is a violation of the Environmental Protection Act and may result in additional enforcement action by the Agency.

If I owe fees for more than one permit, can I send one check covering all fee amounts due?

Yes, payment for more than one NPDES permit fee may be made with a single check. Be sure to include all of the fee notices in the return envelope to ensure that the Agency credits the proper accounts. However, payments for non-NPDES fees should be made separately.

What happens if I don't pay my fee?

Failure to pay the annual NPDES fee by the due date results in interest penalties being assessed. Failure to pay the fee in full is also a violation of the Environmental Protection Act and may result in additional enforcement action by the Agency.

What is the interest rate that will be charged on late payment amounts?

The current interest rate is 5 percent per year. It is adjusted on a semi-annual basis, on January 1 and July 1 of each year.

I only use my permit six months out of the year. Do I get charged in full?

Yes. Your permit covers the current year, whether or not your activity is continuous during that time.

What if I no longer need my permit because the activity under permit has been discontinued?

You should send the Agency a request to terminate your permit prior to the due date shown on the fee invoice. If the permit is for a Storm Water Construction Site Activity, a Notice of Termination must be sent prior to the due date. The fee is due and payable if the termination notice is not received by the due date. Also, all fees and interest amounts due from prior years are due and payable.

I need to know the Illinois EPA's federal employer identification number (FEIN) in order to process the fee payment in my company's accounting system. What is the IEPA's FEIN?

The Agency FEIN is 01-0572642.

Construction Permit Fees For Industrial Wastewater Sources

Who is covered?

Applicants for construction permits for any treatment works, industrial pretreatment works, or industrial wastewater source are covered. No fee is required for a treatment works or wastewater source directly covered and authorized under an NPDES permit issued by the Agency.

What is the fee?

  1. A $1,000 fee shall be required for any industrial wastewater source that does not require pretreatment of the wastewater prior to discharge to the publicly owned treatment works or publicly regulated treatment works.
  2. A $3,000 fee shall be required for any industrial wastewater source that requires pretreatment of the wastewater for non-toxic pollutants prior to discharge to the publicly owned treatment works or publicly regulated treatment works.
  3. A $6,000 fee shall be required for any industrial wastewater source that requires pretreatment of the wastewater for toxic pollutants prior to discharge to the publicly owned treatment works or publicly regulated treatment works.
  4. A $2,500 fee shall be required for construction relating to land application of industrial sludge or spray irrigation of industrial wastewater.

Water Quality Certification Application Fees

Who is covered?

Applicants for a state water quality certification required by Section 401of the federal Clean Water Act for federal authorization by the Corps of Engineers under Section 404 are required to pay a fee to the Illinois EPA. The fee does not apply to the State or any department or agency of the State, nor to any school district.

What is the fee?

The fee amount is $350 or 1 percent of the gross value of the proposed project whichever is greater, with a maximum fee of $10,000 for any application. The fee must be included with all applications.
