U.S. HOUSE of REPRESENTATIVES
Approves NEA Funding

American for the Arts Advocacy turned to its grassroots constituency to email their Reprsentatives for increased NEA funding. Here's the results:

June 16, 2004

Dear Arts Advocates,

At 6:10 p.m.June 16, 2004, the U.S. House of Representatives approved the Arts Caucus Amendment to increase funding for the National Endowment for the Arts (NEA) by $10 million and the National Endowment for the Humanities (NEH) by $3.5 million. The amendment passed by a vote of 241 to 185. By way of comparison, last year's votes were 225 to 200 with 35 Republicans voting FOR the Arts Caucus Amendment. This year, 48 Republicans voted for the amendment.

The House also defeated an amendment by Rep. Tom Tancredo (R-CO) which would have decreased NEA funding by $60 million, by a vote of 313 to 112, identical to last year's vote.

The Congressional Arts Caucus Amendment was sponsored by Reps. Louise Slaughter (D-NY), Chris Shays (R-CT), Norm Dicks (D-WA), and Jim Leach (R-IA).

Copyright Awareness Month

During Copyright Awareness Month, copyright experts and educators throughout the country will seek to teach people about the basic purpose of copyright as articulated in our Constitution-- to promote the advancement of the arts by providing creators with the exclusive rights to their works for limited terms. A public that has a basic understanding of copyright law and its relationship to the arts -- including its fair use exceptions -- is far more likely to respect and comply with the law, than one that functions on misinformation. Channel 13 Collective Bargaining

We have just concluded collective bargaining negotiations to protect artists working for Channel 13 in NYC. Brian Whitehall, a Channel 13 Guild member, has gone above and beyond to help shape this contract process. Thanks Brian! Special thanks also go out to Staciellen Heasley for her great contract and legal-ese translations. Everyone involved fought hard and your work is appreciated!


Hire a Union Artist Campaign

The "Hire A Union Artist Campaign" is close to launch!  Unions contract out design, layout and illustration work every year.  Guild members should be doing it!  Other unions do not realize they can hire union artists.  The "Hire A Union Artist Campaign" is designed to raise awareness of the Guild among other unions, encourage unions to hire Guild artists and provide a Guild only job board where we can all go to find project opportunities.

Copyright Infringement Lawsuit Won

Photographer Jerry Greenberg and the ASMP win the appeal of copyright infringement lawsuit against "National Geographic." The US District Court awards the photographer maximum statutory damages of $100,000. Decision of appeal of the Tasini (National Writers Union) v. Copyright Office to Hold Hearings

The Copyright Office of the Library of Congress will be holding public hearings in its rulemaking on the possible exemptions to the prohibition against circumvention of technological measures that control access to copyrighted works. In accordance with the Copyright Act, as amended by the Digital Millennium Copyright Act, the Office is conducting its triennial rulemaking proceeding pursuant to 17 U.S.C. section 1201 to determine whether there are particular "classes of works" as to which users are, or are likely to be, adversely affected in their ability to make noninfringing uses if they are prohibited from circumventing such technological measures.

Public hearings will be held in Washington, D.C., on Friday, April 11, 2003; on Tuesday, April 15, 2003; on Wednesday, April 30, 2003; and on Friday, May 2, 2003. The hearings will begin at 9:30 a.m. For locations, see the Federal Register notice announcing the hearings.

Public hearings will also be held in California in May at a time and location to announced later. Requests to testify at the Washington, D.C., hearings must be received by 5:00 p.m. EST on April 1, 2003.
