Reauthorization Memoranda

Provided below are implementing memoranda for the Child Nutrition and WIC Reauthorization Act of 2004 (Pub. L. 108-265) for provisions pertaining to the CACFP.  All files are in Adobe Acrobat (.pdf) format.  

Age Limits in the CACFP (Aug. 10, 2004)
Beginning October 1, 2004, homeless shelters may be reimbursed for meals served to children 18 years of age or younger.  The former age limit was 12 years and younger (15 years or younger for children of migrants).   
Overpayment Disregards in CACFP (Sept. 17, 2004)
Effective October 1, 2004, the overpayment amount as a result of Federal or State management evaluations, reviews or audits may be disregarded up to $600 or less.   
Agreements in the CACFP (July 12, 2004)
Explains that sponsor's agreements taken with family and group day care homes must be permanent.  Sponsors have until Jul 1, 2005, to have permanent agreements with all of their homes.  
Duration of Tiering Status for Family Day Care Homes (July 8, 2004)
Explains that family day care homes whose eligibility is based upon school data may be certified for Tier I status for 5 years, instead of the previous 3 year limit.    
For-Profit Center Eligibility in the CACFP (July 1, 2004)
Explains that the Child Nutrition and WIC Reauthorization Act made permanent the provision that for-profit centers may participate in the CACFP is 25% of children (enrolled or licensed capacity) are eligible for free or reduced price meals.
