STATEMENT OF THE DEPARTMENT OF HEALTH
AND HUMAN SERVICES REGARDING IMPLEMENTATION
OF ORGAN TRANSPLANT FINAL RULE

Today the HHS final rule on the Organ Procurement and Transplantation Network comes into effect. With this rule in place, the obligations of the OPTN are clearly defined, as is the public process for reviewing and enforcing OPTN policies. The final rule is an important element in ensuring that our organ transplant system will operate in the fairest and most medically effective way possible for the American people.

The implementation of the final rule is a starting point, not an ending point. The Department intends to work constructively with the entire transplant community. At the same time, we will also continue working with members of Congress as they consider legislation to reauthorize the National Organ Transplantation Act. Our shared goal is the best possible organ procurement and transplant system for Americans.
