Mendocino National Forest
Off Highway Vehicle Use

Pursuant to the provisions of Title 36 Code of Federal Regulations 261.50(a) and/or (b), in order to provide for public safety and protection of natural resources, eather of the following is prohibited on any area, or Forest development road or trail within the Mendocino National Forest:

  1. Use of any off highway vehicle or other vehicle on any forest development trail not designated for that purpose. 36 CFR 261.55(b).
  2. Use of any off highway vehicle or other vehicle off any forest development road or trail. 36 CFR 261.56.
  3. Use of any off highway vehicle or other vehicle on any forest development trail after receiving 2 inches or more of rainfall in the preceding 24 hour period. The period of closure will remain in effect until there 48 hours of NO measurable precipitation. 36 CFR 261.56.

This order supersedes Order No.79-05, dated December 20, 1979.

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
  2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

This prohibition is in addition to the general prohibitions in 36 CFR Part 261, Subpart A and all applicable State provisions of the California Vehicle Code.

A violation of this prohibition is punishable by a fine of not more that $5,000.00 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.
