Corps reviews Eugene permit application

PORTLAND, Ore. — The U.S. Army Corps of Engineers is reviewing an after-the-fact application for a Department of the Army permit for certain work in waters of the United States. The public notice regarding this permit application was issued during the week of Nov. 26.

Public Notice NWP-2007-539, requested by Mr. John Roberts. The project is located at 85242 Peaceful Valley Road near Eugene, Ore. The applicant conducted several activities in the summer of 2006 to prevent streambank erosion and improve drainage on an unnamed tributary of Spencer Creek. The project affected the capacity and flow of about 380 feet of the stream channel.

Comments on this project must be received by Dec. 29.

The Corps of Engineers is soliciting comments from the public, federal, state and local agencies, Indian Tribes and other interested parties on this permit request. A copy of the public notice may be found at http://www.nwp.usace.army.mil/op/g/public.asp.

The Corps of Engineers will issue or deny any permit under authority of Section 404 of the Clean Water Act, for discharge of dredged or fill material into U.S. waters, and/or under Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.

If a permit is issued, the Corps will decide on the appropriate and practicable compensatory mitigation for the proposed project.
