Corps evaluates application for "after-the-fact" permit

Portland, Ore.-The U.S. Army Corps of Engineers is evaluating a permit application from an Astoria citizen for work that has already begun near Juniper Street in Warrenton, Ore.

The applicant is requesting a permit to retain .74 acres of wetland fill placed without Department of the Army authorization. The fill will be used to extend and improve Juniper Street and to create a 12-lot residential subdivision.

The Corps has reviewed the unauthorized activity and determined that impacts from the project do not warrant legal action at this time.

If a decision is made to issue the permit, the Corps will evaluate the need for compensatory mitigation. The applicant's preliminary mitigation plan has three components to include: restoration of about 6,000 square feet of scrub-shrub wetland adjoining the project site; planting Sitka spruce along the eastern property boundary; and to construct a one-acre freshwater wetland north of the site along Clear Lake.

As part of its permit evaluation process, the Corps is requesting public review and comment on the proposed project prior to making its permit decision.

The Corps also is soliciting input from federal, state and local agencies and officials, Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity on endangered species, cultural resources, water quality, general environmental effects, and other public interest factors.

The Corps will evaluate the permit request under Section 404 of the Clean Water Act for discharge of dredged or fill material into waters of the United States

A permit will not be issued until the state has concurred with the applicant's certification that the described activity affecting land or water uses in the Coastal Zone complies with State Coastal Zone Management Program, Section 307 of the Coastal Zone Management Act of 1972, and Section 401 of the Clean Water Act.

Preliminary determinations indicate the proposed project will not affect endangered species or their critical habitat. Formal consultation under Section 7 of the Endangered Species Act of 1973 is not required.

The proposed project is not located on property registered in the latest version of the National Register of Historic Places. This notice has been provided to the State Historic Preservation Office.
