PORTLAND, Ore. — The Portland District, U.S. Army Corps of Engineers is seeking comments on its proposal to authorize certain work in navigable Oregon waters using an abbreviated processing procedure called a Letter of Permission.
The District proposes to authorize by Letter of Permission temporary structures, permanently moored floating vessels, certain maintenance dredging activities, installation and removal of piling, and installation of small boat docks.
Corps regulations at 33 CFR 325.2(e)(1)(i) allow the use of such a procedure to review cases subject to Section 10 of the Rivers and Harbors Act of 1899 when the proposed work would be minor, would not have significant individual or cumulative impacts on environmental values, and should encounter no appreciable opposition.
The Letter of Permission procedure includes required coordination with federal and state fish and wildlife agencies and a public interest evaluation, but does not include issuing an individual public notice.
The Corps is soliciting comments on this proposal from the public; federal, state and local agencies; Indian Tribes; and other interested parties. Comments must be received by Dec. 3.
The Corps issues or denies permits under authority of Section 404 of the Clean Water Act for discharge of dredged or fill material into U.S. waters, and/or Section 10 of the Rivers and Harbors Act of 1899 for work in or affecting navigable waters of the United States.
