Consumer Product Safety Information Act: Are Consignment Shops and Thrift Stores Affected By HR4040?

The answer is, "yes and no."

Up until yesterday however, it was a resounding, "yes."

But thanks to everyone that spoke up, the Consumer Product Safety Commission (CPSC) went ahead and outlined some exemptions for baby clothes consignment store and thrift shops. However, they're not totally off the hook.

It's also been reported by KVAL, a television station out of Eugene, Oregon, that there have been a few, tentative changes that are undoubtedly making small, independent artists breath a sigh of relief. These exemptions are open for public comment for the next 30 days. While they may not end up being permanent, it's nice to know that the CPSC is at least considering them. The tentative changes are as follows:

  • Toys, clothing, and other goods made of natural materials like cotton and wood.
  • Toys with lead parts that children cannot access.
  • Electronics that cannot be made without lead.

I'm sure we haven't heard the last of this and I'm curious to know how much more will change between now and the effective date of February 10th. Also, as a bit of an environmental junkie, I'm wondering just how many textiles may now end up in landfills and how this will affect the organic baby clothes market; I'm willing to bet that they'll see a large increase in their sales volume in the coming months.

I really and truly hoped that it wouldn't come to this. But in early December, I read the issue of People which had a cover story about K-Fed's life after Britney, and he mentioned the clothing line. In fact, he said that he's had so much experience dressing his kids he feels totally qualified to design his own line.

I snorted, out loud, and then put it out of my mind.

Then today, I notice on the People website, that they've mentioned it, again.

Once again, I ask, "does being a celebrity entitle you to a baby clothes line?"

I'm hoping that's not the case.

As a crafty kind of gal who is always in my basement workshop creating new stuff, this bill is particularly disturbing in its omission of independent baby toys and baby clothes creators.

While I've never gotten up the nerve to actually sell my creations, I have lots of friends who supplement their income with the clothes they sew and the toys they make.

If you are a fan of all things handmade, especially when it comes to baby toys and clothes, you need to take a look at this. And more importantly, you need to act on it right away.
