Subject: PER– Revocation of Approved Leave-Exigency of Service Declaration

To: All Employees

Purpose: To advise all employees of revocation of approved leave.

Expiration Date: December 31, 2009.

Effective Immediately - November 24, 2008

Background: National Bulletin NB-360-9-14, PER – Exigency of Service Declaration dated November 19, 2008, (http://directives.sc.egov.usda.gov/22054.wba) advised all employees of the exigency of service declaration for work associated with the 2008 Financial Audit open obligations review. In this bulletin, Chief Lancaster declared that work associated with the NRCS 2008 Financial Audit open obligations review, an exigency of service for the remainder of the 2008 calendar year. Consequently, employees whose annual leave for the period of December 1, 2008, to December 19, 2008, which was approved in writing prior to November 22, 2008, is subsequently cancelled and will be eligible to have any forfeited annual leave restored after the end of the leave year, which is January 3, 2009. Annual leave restoration cannot be requested until leave is forfeited, after the end of the leave year, but no later than April 1, 2009. Revocation of Approved Leave: Effective December 1, 2008, through December 19, 2008, ALL approved requests to use annual leave, credit, compensatory, and other leave except sick leave, is revoked. Note: If all of the required work is not accomplished by December 19, 2008, the revocation of approved leave will be extended through December 31, 2008.

Requests for Exception: For the remainder of the leave year, requests for leave use, except incidental sick leave and incidental leave requests (discussed below) must be submitted in writing.

Process to Request an Exception: Employees submit requests by e-mail to their supervisor. Each request must include justification that explains special circumstances or hardship.

If the supervisor supports approval of the request, the supervisor will forward the request, by e-mail, with a “cc” through their Assistant State Conservationist for Field Operations (ASTC-FO), to Jon Hempel, Acting State Conservationist, at jon.hempel@wv.usda.gov. The justification should include a statement verifying that the review deadlines will not be adversely impacted if the leave is approved. In order to insure confidentiality, employees and/or supervisors may provide additional information to the STC only by e-mail or phone. Requests will be evaluated on a case-by-case basis.

Supervisors are not directed to recall employees currently on approved leave. Individually, those situations should be discussed between the State Conservationist (STC) and the supervisor.

Incidental Leave Requests: We recognize that there will be some incidental leave requests that will occur. This includes necessary infrequent brief absences; typically, less than 2 hours. Supervisors are to handle these requests within their discretion. Requests must be submitted in writing as soon as possible in advance of the absence. The supervisor’s Approval/Disapproval of the request must be in writing.

Accomplishing the Review: It may be necessary that employees work beyond their regular tour of duty to accomplish the review.

Credit Hours: Since leave approvals will be by exception only, employees should not earn any credit leave above the 24 hour ceiling; any credit leave above the ceiling is forfeited at the end of a pay period and cannot be restored or otherwise compensated. Once at the credit leave ceiling, requests beyond the 8 hour tour of duty should be for overtime.

Overtime: Overtime work must be pre-approved on the “Overtime Authorization Request” form. Overtime approval up to 20 hours can be approved by the Assistant State Conservationist for Field Operations and by Principal Staff Supervisors. Overtime above 20 hours must be approved by the State Conservationist.

WebTCAS: As discussed in the statewide teleconference on November 21, 2008, be sure and charge all work related to the financial audit to the “NRCS Financial Audit Follow-up” activity code. Time charged should be captured under the appropriate program for any activity performed related to this follow-up process.
