Subject: LTP - 2009 EQIP Payment Policy for EQIP 1996 Farm Bill Contracts

To: All Offices

Purpose: To issue guidance on the annual payment limitations of EQIP 1996 Farm Bill contracts.

Expiration Date: September 30, 2009.

Background Information: The 1996 Farm Bill established a limitation of $10,000 on the annual payments that could be made through each EQIP contract. Congress recognized this as a burden on producers and lifted that restriction in the 2002 Farm Bill for new contracts. The NRCS State Conservationist has the authority to waive this restriction on those older contracts.

Fiscal Year 2008 (FY08) Policy: This bulletin will serve as a blanket waiver for any EQIP 1996 contract where the contract participant wishes to install contracted practices that exceed the $10,000 annual payment limitation. The EQIP 1996 contracts include those that were entered into under the rules of the 1996 Farm Bill and are designated as “EQIP 1996” in ProTracts.
