CONTINUING WITHDRAWAL PERMITS FOR SDA/SDR BONDED DEALERS AND USERS

Bonded Dealers and Users of Specially DenaturedAlcohol/Rum and Distilled Spirits Plant Proprietors

Purpose. The purpose of this circular is to advise industry members of the new regulations regarding the elimination of the requirement for bonded dealers and certain users of specially denatured alcohol/rum to annually make application for and receive a new withdrawal permit.

The final rule, T.D. ATF-103, amended regulations in 27 CFR Parts 211 and 213. The specific changes which affect dealers and users of specially denatured alcohol/rum and DSP proprietors are as follows:

(a) Bonded Dealers - Withdrawal permits issued on Form 1477 (5150.15) to bonded dealers of specially denatured alcohol/rum which are annotated to expire October 31, 1982, will continue in effect indefinitely. It is not necessary to submit an application for renewal of the November 1, 1982 - October 31, 1983 withdrawal permit, or for any succeeding withdrawal permit. (Section 211.133 of 27 CFR is removed).

(b) Users - Withdrawal permits issued on Form 1485 (5150.12) to users of specially denatured alcohol/rum which are annotated to expire on October 31, 1982, will continue in effect indefinitely. It is not necessary to submit an application for renewal of the November 1, 1982 - October 31, 1983 withdrawal permit, or for any succeeding withdrawal permit. (Section 211.163 of 27 CFR is removed).

(c) Shipments by Bonded Dealers and DSP Proprietors - Bonded dealers and DSP proprietors are authorized to make shipments after October 31, 1982,of specially denatured alcohol/rum to users and/or dealers whose permits expire on October 31, 1982. This authorization is based upon the fact that all the above mentioned withdrawal permits will be "valid" after the expiration date, indefinitely, in the same manner as "limited" withdrawal permits.

ATF believes this amendment will significantly reduce administrative burdens on both industry and the Government.
