Other than Small Business
The U.S. Small Business Administration (SBA) has compiled a list of business entities that its Office of Government Contracting (Government Contracting) has determined are other than small under specific size standards. SBA is making this list available for contracting officers, SBA personnel and other interested members of the public. SBA's statutory authority to determine whether a concern qualifies as a small business rests in the Small Business Act, at 15 U.S.C. 632(a) and 637(b)(6). SBA's Small Business Size Regulations are located at 13 CFR part 121, and the applicable Federal Acquisition Regulations (FAR) are located at 48 CFR part 19.
In most cases, SBA determined the size status of the listed firms after receiving protests challenging the firm's self-certification that it qualifies as a small business under the size standard for the North American Industry Classification System (NAICS) code assigned to a particular Federal procurement. In other instances SBA determined the size standard for the listed firms in connection with other SBA or Federal Government programs or regulatory actions.
SBA's size determinations are based on the existing size standards set forth in SBA's Small Business Size Regulations. Size standards vary from industry to industry, as defined under NAICS, which replaced the Standard Industrial Classification (SIC) system. There is a single table of small business size standards that applies to both Federal procurement and SBA's financial assistance programs. A few SBA programs, such as the Small Business Innovation Research (SBIR), Small Business Investment Companies (SBIC) and Surety Bond Guarantee (SBG) Programs, have unique size standards designed to accommodate their specialized needs. All Federal agencies are required to use SBA's size standards for their programs in the absence of Congressional authority or specific approval from SBA's Administrator to do otherwise.
The list of firms SBA determined to be other than small under specific size standard contains only those that SBA made in the Federal Government's current fiscal years beginning with FY 2005. It does not include those that SBA subsequently determined were small businesses. Size standards based on a concern's annual receipts are determined by the concern's three most recently completed fiscal years. Size standards based on a concern's number of employees are determined by the concern's twelve most recently completed calendar months (i.e., not its calendar year).
