ACHP Issues Program Comments for DoD

November 14, 2008 - At the Advisory Council on Historic Preservation (ACHP) quarterly business meeting today, the ACHP issued Program Comments, pursuant to 36 CFR 800.14(e), for the Department of Defense (DoD) setting forth how it will comply with Section 106 of the National Historic Preservation Act when rehabilitating exterior building elements that are character-defining features of historic properties.

Under Section 800.14(e) of the regulations, agencies can request the ACHP to provide a Program Comment on a particular category of undertakings in lieu of conducting individual reviews of each individual undertaking under such category, as set forth in 36 CFR 800.4 through 800.7. An agency can meet its Section 106 responsibilities for considering the effects of particular aspects of those undertakings on historic properties by following the steps set forth in the Program Comment.

Following the Program Comment will reduce compliance timeframes for routine repairs and maintenance undertakings involving historic properties where DoD chooses to repair and maintain those resources in accordance with the Secretary of the Interior’s Standards. The development of these initial five treatment measures is the result of substantial discussions with key participants in the consultative process, such as the National Park Service, the American Institute of Architects, the American Institute for the Conservation of Artistic and Historic Works and ACHP staff.

The ACHP looks forward to the development of further treatment measures under this program comment that will further assist the DoD in managing their historic resources. While many personnel worked hard on this effort, special credit is due to Brian Lusher of DoD, Héctor Abreu-Cintrón of the ACHP, and representatives of the National Park Service who provided highly technical expertise and long-term vision to this approach.
