Where is My Determination Letter Request? |
|
With the closing of Cycle A of the Staggered Remedial Amendment Period, practitioners and plan sponsors may notice an increase in the timeframe to process an application for determination for an employee benefit plan. (i.e., Forms 5300, 5307, 5310 and 6406)
Currently, most of the cases we are assigning to specialists are Cycle B cases. “On-cycle” cases are generally worked in postmarked date order, with priority given to Form 5310 termination applications. “Off-cycle” applications are placed in suspense and will be processed only after all the “on-cycle” cases are processed. However, you should receive an acknowledgement letter for both types of filings (on- and off-cycle).
In an effort to provide better customer service, we will keep you updated on our progress in reducing the backlog of determination letter applications by periodically posting information to this web page regarding the form number and the postmarked date we are currently processing. Employee Plans specialists are currently reviewing cases that have the following postmarked dates:

If you submitted your application during or after the month in the “Postmarked Date” column and you received an acknowledgement notice then we have received your application but it has not been assigned to an Employee Plans specialist. Keep checking this web page for updates and await IRS Contact. There is no need to call.
If you submitted your application before the “Postmarked Date” and the IRS has not contacted you regarding your application, you may want to contact TE/GE Customer Assistance.
You will need the following information before you contact the IRS to verify the status of a determination letter application:
-
Name of the employer;
-
Employer’s employer identification number (available on the Form W-2);
-
Name of the plan;
-
Plan number;
-
Application number;
-
Date application was submitted;
-
Indicate whether or not you are the plan sponsor, working for the plan sponsor or a plan participant; and
-
Practitioners may need to submit a valid Power of Attorney.
