OCC 2006-14 OCC BULLETIN Subject: Controlling the Assault of Non- Solicited Pornography and Marketing Act of 2003 (CAN-SPAM) Description: Examination Procedures Date: March 30, 2006 TO: Chief Executive Officers and Compliance Officers of All National Banks, Department and Division Heads, and All Examining Personnel The Federal Trade Commission (FTC) issued regulations for implementing CAN-SPAM that became effective March 28, 2005. The FTC has also issued regulations that contain criteria pertaining to warning labels on sexually oriented materials, which became effective as of May 19, 2004. The Federal Financial Institutions Examination Council's Task Force on Consumer Compliance approved interagency consumer compliance examination procedures for both of these regulations. These examination procedures are attached. The OCC plans to incorporate these procedures in an update to the Comptroller's Handbook series. Until the revised handbook is issued, examiners should use the attached procedures.
