OCC 2002-18 OCC Bulletin Subject: Community Reinvestment Act Description: Income Level, Median Family Income Date: May 22, 2002 TO: Chief Executive Officers and Compliance Officers of All National Banks, Department and Division Heads, and All Examining Personnel Attached are 1990 U.S. Census and 2002 Department of Housing and Urban Development (HUD) estimated median family incomes for metropolitan statistical areas (MSA) and non-MSA portions of each state. The annual HUD data are used to determine borrower income levels in Community Reinvestment Act (CRA) performance evaluations. The regulation implementing the CRA, 12 CFR 25, classifies the income level of an individual or geographic area as low-, moderate-, middle-, or upper-income, based on the area median income. Area median income is defined as "the median family income for the MSA, if a person or geography is located in an MSA" or "the statewide non- metropolitan median family income, if a person or geography is located outside an MSA." Low-income means an individual income that is less than 50 percent of the area median income, or a median family income that is less than 50 percent, in the case of a geography. Similarly, moderate-income means an individual income that is at least 50 percent and less than 80 percent of the area median income, or a median family income that is at least 50 percent and less than 80 percent, in the case of a geography. Middle-income means an individual income that is at least 80 percent and less than 120 percent of the area median income or a median family income that is at least 80 percent and less than 120 percent, in the case of a geography. Upper-income means an individual income that is 120 percent or more of the area median income, or a median family income that is 120 percent or more, in the case of a geography.
