FERC 580 - Interrogatory on Fuel and Energy Purchase Practices
    Overview

    Response to this interrogatory is mandatory.The information collected under FERC-580 is used by the Commission to implement the statutory provisions governed by Section 205(f) of the Federal Power Act (FPA) as amended by Section 208 of the Public Utility Regulatory Policies Act of 1978 (PURPA).  The FERC-580 interrogatory began in 1979 with a Commission Order issued under Docket No.IN79-6, to collect the information every other year as mandated by statute.  The information collected through the FERC-580 interrogatory is used by Commission staff to review utility fuel purchase and cost recovery practices through wholesale fuel adjustment clauses (FACs) to ensure efficient use of resources, in compliance with the Commission’s FAC regulations promulgated in 18 CFR§35.14.  The information is also used by the Commission to evaluate fuel costs in individual rate filings and to supplement periodic utility audits

    Who Must Submit
    All jurisdictional utilities owning and/or operating at least one steam-electric generating station of 50 MW or greater capacity, or having a majority ownership interest in a jointly-owned steam-electric generating station of at least 50 MW and that had a cost-based rate tariff on file with the Commission during the reporting period are required to file a FERC-580.

    When to Submit
    The FERC-580 Interrogatory is due on September 15, 2008.

    How and What to File
    For report year 2008, Commission staff has created a new Microsoft Excel workbook version of the FERC-580 for filers to use in lieu of the Word version of prior years. A Microsoft Word version of the FERC-580 is available and will be accepted; however, the Excel version is strongly preferred. Use of the Excel workbook will aid in possible automation of the FERC-580.

    If respondents choose the option of using the Excel workbook, they are encouraged to use the following file naming convention when they eFile:

      CompanyName_2008_FERC-580.xls

    Respondents who choose to use the Word version of the 2008 FERC-580 should use the same naming convention, but make the extension .doc. For example:

      CompanyName_2008_FERC-580.doc

    Please do not convert the Excel workbook or the Word document to portable display format (.pdf) as it will inhibit Commission data analysis.

    Any other necessary documents that are required to accompany the filing, such as the organization charts required by Question 6, may be eFiled at the same time as the Excel workbook or Word document. The file naming convention would be more specific to those documents. For example, a Word file with the organization chart required by Question 6 would be named as follows:

      ABCElectricCompany_2008_FERC-580_Q6.doc

    Please be aware that all eFiled attached documents must be in electronic file formats accepted by the Commission. In addition, all parts of any submission that are created or available in text searchable native application format must be submitted in that format or in Print-to-PDF format. Failure to provide text-searchable formats in eFiled documents may result in a request for re-submission or rejection of the filing.

    Respondents who choose the Excel workbook option, and who need to file a change to a filed response can do so by eFiling the workbook with the revised information changing the filename. For example, if the respondent needs to change the response provided for Question 2, the respondent would make the change and name the revised file as follows:

      UtilityABC_2008_FERC-580_Q2_revised.xls

    The respondent should include a cover letter with the eFiled revision explaining the circumstances that required the revision.

    Also, please be aware that the Commission’s eFiling system can accept only documents that are less than 50 MB in size.

    Non-eFilers
    For respondents who do not choose to eFile their response to the FERC-580, filing instructions can be located on the Commission’s website here: http://www.ferc.gov/docs-filing/hard-fil.asp

    Hardcopy paper copies may be submitted in lieu of the Excel workbook. Two paper copies of the response and one copy in electronic form, which will be considered public information, should be sent to:

    Privileged information
    As has been the case in previous FERC-580 filing years, the Office of Management and Budget has approved the public release of all information collected in the FERC-580. Requests for privileged treatment of information, that if disclosed, would violate the terms of a rail transportation contract confidentiality clause, will be considered. Those requesting privileged treatment should be specific in the request for privileged treatment as to the rail contract and terms involved. Privileged treatment requests must also comply with 18 CFR 388.112.
