Federal Projects
The U.S. Army Corps of Engineers coordinates with the
Service planning and review of water resource projects.
Examples of such projects include flood control, dredging
and site remediation. The Service makes recommendations
to ensure that the proposed Federal projects are planned
and executed to give fish and wildlife and their habitats
due consideration as other factors, such as economics
and recreation.
Permits
Section 404 of the CWA regulates the discharge of dredged
or fill material into waters of the United States, including
wetlands. The Service reviews permit applications and
project proposals that propose to impacts waters. Under
Section 404(b)1 of the Clean Water Act, applicants are
required to avoid, minimize and finally mitigate unavoidable
impacts to waters of the United States, including wetlands.
The Service serves in an advisory capacity to the U.S.
Army Corps of Engineers for projects that propose to
impact waters. The Service assesses impacts of proposed
projects on fish and wildlife resources and habitats
through application of the Fish and Wildlife Coordination
Act, Clean Water Act, National Environmental Policy
Act and the Migratory Bird Treaty Act.
