Pursuant to 36 CFR 261.50(a) and (b), and to protect natural resources and public safety, the following act is prohibited within the Tahoe National Forest. This order is effective from November 3, 2003,  through November 2, 2005.

1.      When there is snow on the ground, using or possessing a motor vehicle in the Placer Big Trees Closure area, as shown on the attached map.  36 CFR 261.53(a).

2.      When there is snow on the ground, using or possessing a motor vehicle in the Oak Flat and North Fork American River Closure areas, as shown on the attached map.  36 CFR 261.53(b).

3.      When there is snow on the ground , using or possessing a motor vehicle in the Babbit and Sagehen closure areas, as shown on the attached map.  36 CFR 261.53(d).

4.      When there is snow on the ground, using or possessing a motor vehicle in the Pole Creek, Donner Summit, Steephollow, and North Yuba closure areas, as shown on the attached map.   36 CFR 261.53(e).

5.      When there is snow on the ground, using or possessing a motor vehicle on National Forest  System roads in the Pole Creek, Sagehen, Donner Summit, Babbit, Steephollow, Placer Big Trees, and North Yuba closure areas.  36 CFR 261.54(a).

6.      When there is snow on the ground, using or possessing a motor vehicle on National Forest System road that has been designated as a marked or groomed snowmobile route on the attached map.  36 CFR 261.55(b).

7.      When there is snow on the ground, using any rubber-tired vehicle on a National Forest System road that has been designated as a marked or groomed snowmobile route on the attached map.  36 CFR 261.54(a).

8.      When there is snow on the ground using any rubber-tired vehicle on a National Forest System trail that has been designated as a marked or a groomed snowmobile route on the attached map.  36 CFR 261.55(b).

9.      Using or possessing a motor vehicle in the Kyburz closure area from February 1, 2004, through July 15, 2004, and from February 1, 2005 through July 15, 2005.  The Kyburz closure area is shown on the attached map.  36 CFR261.53(b).

Pursuant to 36 CFR 261.50(e), the following persons are exempt from this order:

1. Persons with a permit from the Forest Service specifically authorizing the otherwise prohibited act or omission.

2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

3. Persons with disabilities using assistive devices or aids are not prohibited from using the assistive devices or aids in the areas or on the roads and trails described above.  An assistive device is a piece of equipment, such as a wheelchair, used by a person with a disability on a daily basis to help in the accomplishment of one of life’s major functions or activities.  A wheelchair is defined in the Americans with Disabilities Act to be “a device designed solely for use by a mobility impaired person for locomotion, that is suitable for use in an outdoor pedestrian area.” 42 USC 12207(c)(2).

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

A violation of this prohibition is punishable by a fine of not more than $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581
