  • Extension of the Presumptive Period for Compensation for Gulf War Veterans' Undiagnosed Illnesses - The Department of Veterans Affairs (VA) published a final rule in the Federal Register on December 27, 2002, to affirm an amendment to VA adjudication regulations regarding compensation for disabilities resulting from undiagnosed illnesses suffered by Persian Gulf War veterans. The amendment extends the period within which such disabilities must become manifest to a compensable degree in order for entitlement for compensation to be established. The amendment ensures that veterans with compensable disabilities due to undiagnosed illnesses that may be related to active service in the Southwest Asia theater of operations during the Persian Gulf War may qualify for benefits.

  • Additional Disability or Death Due to Hospital Care, Medical or Surgical Treatment, Examination, Training and Rehabilitation Services, or Compensated Work Therapy Program - The Department of Veterans Affairs published a proposed rule in the Federal Register on December 12, 2002, to amend its adjudication regulations concerning awards of compensation or dependency and indemnity compensation for additional disability or death caused by VA hospital care, medical or surgical treatment, examination, training and rehabilitation services, or compensated work therapy program.
    The proposed amendment provides that benefits will be payable for additional disability or death caused by VA hospital care, medical or surgical treatment, or examination only if VA fault or ``an event not reasonably foreseeable'' proximately caused the disability or death. It further provides that benefits will be payable for additional disability or death proximately caused by VA's provision of training and rehabilitation services or compensated work therapy program.

  • Vocational Training for Certain Children of Vietnam Veterans--Covered Birth Defects and Spina Bifida - The Department of Veterans Affairs published a final rule in the Federal Register on December 6, 2002, to establish regulations regarding provision of vocational training and rehabilitation for women Vietnam veterans' children with covered birth defects. It revises the current regulations regarding vocational training and rehabilitation for Vietnam veterans' children suffering from spina bifida to also encompass vocational training and rehabilitation for women Vietnam veterans' children with certain other birth defects. This is necessary to provide vocational training and rehabilitation for such children in accordance with recently enacted legislation.

  • Notice of Computer Matching Program - The Department of Veterans Affairs published a notice in the Federal Register on November 20, 2002, that the Department will conduct a computer matching program with the Social Security Administration. Data from the proposed match will be utilized to verify the unearned income (i.e., interest, dividends, etc.) of nonservice-connected veterans, and those veterans who are zero percent service-connected (noncompensable), whose eligibility for VA medical care is based on their inability to defray the cost of medical care. These veterans supply household income information that includes their spouses and dependents at the time of application for VA health care benefits.

  • Service Connection by Presumption of Aggravation of a Chronic Preexisting Disease - The Department of Veterans Affairs published a final rule in the Federal Register on November 7, 2002, that proposes to amend adjudication regulations concerning presumptive service connection to reflect a statutory presumption that a chronic disease that preexisted the veteran's entry into military service but was first manifest to a 10-percent degree of disability within a specified period after service was aggravated by the veteran's military service.

  • Civilian Health and Medical Program of the Department of Veterans Affairs (CHAMPVA) - The Department of Veterans Affairs published a rule in the Federal Register on November 1, 2002, that proposes to affirm amendments to the Department's medical regulations to extend CHAMPVA eligibility to persons age 65 and over who would have otherwise lost their CHAMPVA eligibility due to attainment of entitlement to hospital insurance benefits under Medicare Part A; implement coverage of physical examinations required in connection with school enrollment for beneficiaries through age 17; and reduce the catastrophic cap for CHAMPVA dependents and survivors (per family) from $7,500 to $3,000 for each calendar year.

  • Schedule for Rating Disabilities; Evaluation of Multiple Scars - The Department of Veterans Affairs published a proposed rule in the Federal Register on October 29, 2002, to amend that portion of the Department of Veterans Affairs (VA) Schedule for Rating Disabilities that addresses the Skin in order to clarify how to evaluate multiple superficial or deep scars in a uniform and consistent manner.

  • Evidence for Accrued Benefits - The Department of Veterans Affairs (VA) published an final rule in the Federal Register on October 28, 2002, to amend adjudication regulations dealing with accrued benefits, those benefits to which an individual was entitled under existing ratings or decisions, or those based on ``evidence in the file at date of death,'' which were due and unpaid at the time the individual died. ``Evidence in the file at date of death'' is now interpreted as evidence in VA's possession on or before the date of the beneficiary's death, even if such evidence was not physically located in the VA claims folder on or before the date of death. Further, ``evidence necessary to complete the application'' for accrued benefits is now interpreted as information necessary to establish that the claimant is within the category of eligible persons and that circumstances exist which make the claimant the specific person entitled to the accrued benefits. These amendments reflect our interpretation of the governing statute.

  • <Prohibition of Interment or Memorialization in National Cemeteries and Certain State Cemeteries Due to Commission of Capital Crimes - The Department of Veterans Affairs (VA) published a notice in the Federal Register on October 8, 2002, to amend regulations governing eligibility for interment or memorialization in national cemeteries and in State cemeteries receiving State cemetery grants from VA. The final rule concerns statutory provisions designed to ensure that the remains of certain persons who committed Federal or State capital crimes are not interred in such cemeteries and that the memory of such persons is not memorialized in such cemeteries.

  • Enrollment--Provision of Hospital and Outpatient Care to Veterans Subpriorities of Priority Categories 7 and 8 and Annual Enrollment Level Decision - The Department of Veterans Affairs (VA) published a final rule in the Federal Register on October 9, 2002, to implement a national enrollment system to manage the delivery of inpatient hospital care and outpatient medical care. Prior to October 1, 2002, veterans were eligible to be enrolled based on seven priority categories. In this final rule we add veterans awarded the Purple Heart to priority category 3 to implement new statutory requirements. We also delete the copayment provisions from priority category 4 to clarify statutory requirements. In addition, we divide priority category 7 into two new priority categories (7 and 8) to implement new statutory requirements, using the subpriorities for former category 7 for these new categories. Further, we state principles for placing veterans in enrollment categories to help ensure clarity and fairness in making priority category determinations. Finally, we change the VA officials who can make enrollment decisions and provide an additional address for sending a request for voluntary disenrollment.
    Effective Date: This interim final rule is effective January 17, 2003.

  • Extension of the Presumptive Period for Compensation for Gulf War Veterans' Undiagnosed Illnesses - The Department of Veterans Affairs (VA) published a final rule in the Federal Register on September 27, 2002, to amend VA's adjudication regulation governing recoupment of military severance pay from service-connected disability compensation to conform to the statutory provision that, effective September 15, 1981, requires the recoupment of any severance pay from VA compensation. VA is also amending these regulations to reflect the statutory provision that excludes Federal income tax withheld from payments of separation pay, severance pay, and readjustment pay made after September 30, 1996, from VA recoupment.

  • Priorities for Outpatient Medical Services and Inpatient Hospital Care - The Department of Veterans Affairs published an interim final rule in the Federal Register on September 17, 2002, to amend the Department's medical regulations to establish that in scheduling appointments for non-emergency outpatient medical services and admissions for inpatient hospital care, VA will give priority to veterans with service-connected disabilities rated 50 percent or greater and veterans needing care for a service-connected disability.   • Accelerated Payments Under the Montgomery GI Bill--Active Duty - The Department of Veterans Affairs VApublished a rule in the Federal Register on September 11, 2002, that proposes to amend the regulations governing various aspects of the educational assistance programs the Department of Veterans Affairs administers in order to implement some of the provisions of the Veterans Education and Benefits Expansion Act of 2001.   • Testimony Certified or Under Oath - The Department of Veterans Affairs published a proposed rule in the Federal Register on July 31, 2002, to amend its adjudication regulation that requires written and oral testimony to be certified or given under oath or affirmation in most cases.   • Suspension of CHAMPVA or TRICARE or TRICARE-for-Life Eligibles' Enrollment in the Federal Employees Health Benefits (FEHB) Program - The Office of Personnel Management (OPM) published a final rule in the Federal Register on June 18, 2002, allow CHAMPVA or TRICARE or TRICARE-for-Life eligible FEHB Program annuitants, survivors, and former spouses to suspend their FEHB enrollments, and then return to the FEHB Program during the Open Season, or return to FEHB coverage immediately, if they involuntarily lose CHAMPVA or TRICARE or TRICARE-for-Life coverage. The intent of this rule is to allow these beneficiaries to avoid the expense of continuing to pay FEHB Program premiums while they are using TRICARE or TRICARE-for-Life or CHAMPVA coverage, without endangering their ability to return to the FEHB Program in the future.

  • Cost-of-Living Adjustments and Headstone or Marker Allowance Rate - The Department of Veterans Affairs (VA) published a notice in the Federal Register, on May 24, 2002, of cost-of-living adjustments (COLAs) in certain benefit rates and income limitations. These COLAs affect the pension, parents' dependency and indemnity compensation (DIC), and spina bifida, and birth defects programs.   • Eligibility for Burial of Adult Children; Eligibility for Burial of Minor Children; Eligibility for Burial of Certain Filipino Veterans - The Department of Veterans Affairs (VA) published a proposed rule in the Federal Register on May 16, 2002, to amend regulations to provide a list of those individuals who are eligible for burial in a national cemetery. Under VA'sstatutory authority to determine which unmarried adult children of eligible persons may be buried in national cemeteries with available space, VA proposes to limit such burials to the remains of those adult children of any age who became permanently incapable of self-support because of a physical or mental disability incurred before their reaching the age of 21 years. VA also proposes to specify that the burial of minor children of eligible persons is limited to those under 21 years of age, or under 23 years of age if pursuing a full-time course of instruction at an approved educational institution.   • Exclusion from Countable Income of Expenses Paid for Veteran's Last Illness Subsequent to Veteran's Death but Prior to Date of Death Pension Entitlement - The Department of Veterans Affairs published a final rule in the Federal Register on February 28, 2002, to amend adjudication regulations governing exclusion of expenses of the veteran's last illness, burial, and just debts from countable income for death pension purposes. This amendment eliminates the prohibition against reducing countable income by the amount of these expenses that the surviving spouse paid after the date of death but prior to the date of his or her entitlement.

  • Civilian Health and Medical Program of the Department of Veterans Affairs (CHAMPVA) - On February 14, 2002, the Department of Veterans Affairs published a correction to the interim final rule published in the Federal Register on January 30, 2002, concerning the ``Civilian Health and Medical Program of the Department of Veterans Affairs (CHAMPVA)''. That interim final rule implemented the provisions of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 and the Veterans' Survivor Benefits Improvements Act of 2001. This document makes a correction in Sec. 17.274(c)(ii) by changing the reference to the effective date of the reduced cost-sharing catastrophic cap from January 1, 2001 to January 1, 2002 to reflect the correct date established by statute.

  • Special Monthly Compensation for Women Veterans Who Lose a Breast as a Result of a Service-Connected Disability - The Department of Veterans Affairs published a final rule in the Federal Register on February 14, 2002, to provide for payment of special monthly compensation for a woman veteran who loses one or both breasts as a result of service-connected disability.
    Correction: A correction to the final rule was published in the Federal Register on May 30, 2002, to correct typographical errors in the "Note" at the end of diagnostic code 7626 in Section 4.116 ``Schedule or ratings--gynecological conditions and disorders of the breast.'' The corrected table was also reprinted on the same date.

  • Diseases Specific to Radiation-Exposed Veterans - The Department of Veterans Affairs published a final rule in the Federal Register, January 25, 2002, to amend its adjudication regulations concerning presumptive service connection for certain diseases for veterans who participated in radiation-risk activities during active service or while members of reserve components during active duty for training or inactive duty training. This amendment adds cancers of the bone, brain, colon, lung, and ovary to the list of diseases which may be presumptively service connected and amends the definition of the term ``radiation-risk activity.'' The intended effect of this amendment is to ensure that veterans who may have been exposed to radiation during military service do not have a higher burden of proof than civilians exposed to ionizing radiation who may be entitled to compensation for these cancers under comparable Federal statutes.

  • Board of Veterans' Appeals: Obtaining Evidence and Curing Procedural Defects Without Remanding - The Department of Veterans Affairs published a final rule in the Federal Register, January 23, 2002, to permit the Board of Veterans Appeals to obtain evidence, clarify the evidence, cure a procedural defect, or perform any other action essential for a proper appellate decision in any appeal properly before it without having to remand the appeal to the agency of original jurisdiction. It also allows the Board to consider additional evidence without having to refer the evidence to the agency of original jurisdiction for initial consideration and without having to obtain the appellant's waiver. By reducing the number of appeals remanded, VA intends to shorten appeal processing time and to reduce the backlog of claims awaiting decision.
    Effective Date: February 22, 2002.
    Applicability Date: These amendments apply to appeals for which the notice of disagreement was filed on or after February 22, 2002, and to appeals pending, whether at the Board of Veterans' Appeals, the United States Court of Appeals for Veterans Claims, or the United States Court of Appeals for the Federal Circuit, on February 22, 2002.

  • Allowance for Private Purchase of an Outer Burial Receptacle in Lieu of a Government-Furnished Graveliner for a Grave in a VA National Cemetery - Public Law 104-275 allows the Department of Veterans Affairs to provide a monetary allowance towards the private purchase of an outer burial receptacle for use in a VA national cemetery, equal to the average cost of Government-furnished graveliners minus any administrative costs to VA. The Department published a notice in the Federal Register, January 17, 2002, regarding the average cost of Government-furnished graveliners, administrative costs that relate to processing a claim, and the amount of the allowance payable for qualifying interments, which occur during calendar year 2002.

  • Diseases Specific to Radiation-Exposed Veterans - The Department of Veterans Affairs published a proposed rule in the Federal Register on August 8, 2001, concerning presumptive service connection for certain diseases for veterans who participated in radiation-risk activities during active service or while members of reserve components during active duty for training or inactive duty training. The Department proposes to add cancers of the bone, brain, colon, lung, and ovary to the list of diseases which may be presumptively service connected and amend the definition of the term ``radiation-risk activity.'' The intended effect of this amendment is to ensure that veterans who may have been exposed to radiation during military service have the same burden of proof as civilians exposed to ionizing radiation who may be entitled to compensation for these cancers under comparable Federal statutes.

  • Board of Veterans' Appeals: Obtaining Evidence and Curing Procedural Defects Without Remanding - The Department of Veterans Affairs published a proposed rule in the Federal Register on August 6, 2001, to permit the Board to obtain evidence, clarify the evidence, cure a procedural defect, or perform any other action essential for a proper appellate decision in any appeal properly before it without having to remand the appeal to the agency of original jurisdiction. The Department also proposes to allow the Board to consider additional evidence without having to refer the evidence to the agency of original jurisdiction for initial consideration and without having to obtain the appellant's waiver.   • Montgomery GI Bill--Active Duty - The Department of Veterans Affairs (VA) published a final rule in the Federal Register on July 30, 2001, to amend educational assistance regulations. The final rule expands the definition of a "program of education" to include a preparatory course for a test that is required or used for admission to an institution of higher education or to a graduate school. This would allow individuals who are eligible for the MGIB to receive benefits for taking a residence course designed to prepare the individual for such tests as the ACT Admissions test and the Law School Admissions Test. The regulations are also amended to provide that when an enlisted service member or warrant officer attends officer training school, and then is discharged to accept a commission as an officer, the enlisted period of active duty and first period of active duty as a commissioned officer may be combined for determining eligibility for the MGIB. These changes are made to reflect statutory changes made by the Veterans Millennium Health Care and Benefits Act of 1999 (PL 106-117).
    Effective Date: July 30, 2001.
    Applicability Date: The changes are applied retroactively to November 30, 1999, to conform to statutory requirements.

  • Collection of Supplemental Security Income Overpayments From Special Benefits for Certain World War II Veterans - The Social Security Administration (SSA) published a proposed rule in the Federal Register on July 26, 2001, to revise our regulations dealing with the recovery of overpayments under the Supplemental Security Income (SSI) program under title XVI of the Social Security Act (the Act). The proposed revisions would modify our regulations to permit SSA to recover SSI overpayments by adjusting the amount of Special Benefits for Certain World War II Veterans (SVB) payable under title VIII of the Act. This collection practice would be limited to individuals who are not currently eligible to receive any cash payments under any provision of title XVI or any State supplementary payments that we administer under title XVI. Also, the amount of SVB to be withheld in a month to recover the SSI overpayment would not exceed 10 percent unless the overpaid person requests us to withhold a different amount or the overpaid person (or his or her spouse) willfully misrepresented or concealed material information in connection with the SSI overpayment. If there were willful misrepresentation or concealment, the entire SVB amount will be withheld to recover the SSI overpayment. These revisions would permit SSA to recover SSI overpayments from SVB payable to the overpaid individual when SSI cash benefits are not payable.

  • Increase in Rates Payable Under the Montgomery GI Bill--Selected Reserve - The Departments of Defense, Transportation, and Veterans Affairs (VA) published a final rule in the Federal Register on July 26, 2001, to adjust the rates of basic educational assistance payable under the Montgomery GI Bill--Selected Reservefor for fiscal year 2001 (October 1, 2000, through September 30, 2001).   • Military Reservist Economic Injury Disaster Loans - The Small Business Administration (SBA) published a final rule in the Federal Register on July 25, 2001, to implement a new program authorized by the Veterans Entrepreneurship and Small Business Development Act of 1999 (Public Law 106-50).   • Copayments for Medications - The Department of Veterans Affairs (VA) published a proposed rule in the Federal Register on July 16, 2001 to amend VA's medical regulations to set forth copayment requirements for medications. This document is necessary to implement provisions of the Veterans Millennium Health Care and Benefits Act. The rule proposes to increase the copayment amount from $2 to $7 for each 30-day or less supply of medication furnished on an outpatient basis for the treatment of a nonservice-connected disability or condition through December 31, 2002. It also proposes to establish an annual copayment cap of $840 through calendar year 2002 for veterans in certain enrollment priority categories. VA is proposing to establish escalator provisions to automatically increase the copayment and the cap amount under certain conditions.

  • VA Acquisition Regulations: Simplified Acquisition Procedures for Health Care Resources - On June 7, 2001, the Department of Veterans Affairs (VA) withdrew a proposed rule concerning simplified acquisition procedures for health-care resources published in the Federal Register on November 9, 1998, and promulgates a new proposed rule concerning simplified acquisition procedures for health-care resources. This new proposed rule would amend the Department of Veterans Affairs Acquisition Regulation (VAAR) to establish simplified procedures for the competitive acquisition of health-care resources, consisting of commercial services or the use of medical equipment or space, pursuant to 38 U.S.C. 8151-8153. Public Law 104-262, the Veterans' Health Care Eligibility Reform Act of 1996, authorized VA to prescribe simplified procedures for the procurement of health-care resources. This proposed rule prescribes those procedures.

  • Loan Guaranty: Title Evidence Requirements and Occupancy Requirements for Conveyance of Properties to VA by Holders; Acceptance of Partial Payments; Indemnification of Default - The Department of Veterans Affairs (VA) withdrew two proposals to amend the loan guaranty regulations in the Federal Register on May 10, 2001. The first withdrawn proposed rule was published in the Federal Register on August 6, 1990 and was related to title documentation required from the holder when VA acquires a property which was financed with a VA-guaranteed loan that has been terminated and to authorize the Secretary of Veterans Affairs to establish a date by which VA must receive such title documentation from the holder.   • Written and Oral Information or Statements Affecting Entitlement to Benefits - The Department of Veterans Affairs published a proposed rule in the Federal Register on April 20, 2001 to amend the Department of Veterans Affairs (VA) adjudication regulations to eliminate the requirement that beneficiaries advise VA of changes affecting their entitlement to benefits in writing. This will allow VA to increase or decrease benefit payments based on information submitted orally or by e-mail, facsimile, or other electronic means and make it easier for beneficiaries to submit information that they must provide. We further propose to amend our notice requirements to allow VA to reduce or terminate benefit payments based on information reported orally without issuing a 60-day advance notice, but only under certain conditions that would ensure that claimants are not deprived of benefits without adequate notice. This would reduce the amounts of any overpayments created by these actions.

  • Federally Mandated Exclusions From Income - The Department of Housing and Urban Development (H.U.D.) published a notice in the Federal Register on April 20, 2001 listing the amounts specifically excluded by any other Federal statute from consideration as income for purposes of determining eligibility or benefits. This Notice updates the list of exclusions last published on August 3, 1993.
    The exclusion applies to any allowance paid under the provisions of 38 U.S.C. 1805 to a child suffering from spina bifida who is the child of a Vietnam veteran.

  • Certification of Evidence for Proof of Service - The Department of Veterans Affairs published a final rule in the Federal Register on April 18, 2001 to amend VA adjudication regulations concerning the nature of evidence that VA will accept as proof of military service. In the past, VA only accepted original service documents or copies of service documents issued by the service department or by a public custodian of records. This change authorizes VA to accept photocopies of service documents as evidence of military service if they are certified to be true copies of documents acceptable to VA by an accredited agent, attorney or service organization representative who has successfully completed VA-prescribed training on military records. The intended effect of this amendment is to streamline the processing of claims for benefits.

  • Cost-of-Living Adjustments and Headstone or Marker Allowance Rate - The Department of Veterans Affairs (VA) published a notice in the Federal Register, March, 28, 2001, of cost-of-living adjustments (COLAs) in certain benefit rates and income limitations. These COLAs affect the pension, parents' dependency and indemnity compensation (DIC), and spina bifida programs. These adjustments are based on the rise in the Consumer Price Index during the one year period ending September 30, 2000.   • Advisory Committee on Women Veterans, Notice of Meeting - The Department of Veterans Affairs (VA) published a notice in the Federal Register on February 26, 2001, that the Advisory Committee on Women Veterans will meet on March 13 - 15, 2001, at the VA Headquarters, 810 Vermont Avenue, NW, Washington, DC The purpose of the Committee is to advise the Secretary of Veterans Affairs regarding the needs of women veterans with respect to health care, rehabilitation, compensation, outreach, and other programs and activities administered by the Department of Veterans Affairs designed to meet such needs. The Committee will make recommendations to the Secretary regarding such activities. The agenda will include the introduction of New Member Ms. Joan Furey, Director, Center for Women Veterans.

  • Well-grounded Claims - On February 26, 2001, the Department of Veterans Affairs (VA) withdrew a proposed rule published in the Federal Register on December 2, 1999, concerning a claimant's statutory responsibility to support his or her claim with adequate evidence to make the claim "well grounded." Subsequent to the publication of the proposed rule, the Veterans Claims Assistance Act of 2000 (Public Law 106-475), was signed into law. The Act eliminated the claimant's responsibility to file a well-grounded claim and redefined VA's duty to help claimants obtain evidence relevant to their claims. VA is withdrawing the proposed rule and preparing a new proposed rule to implement the new statutory requirements.

  • Disease Associated With Exposure to Certain Herbicide Agents: Type 2 Diabetes - The Department of Veterans Affairs (VA) published a proposed rule in the Federal Register on January 11, 2001, to amend adjudication regulations concerning presumptive service connection for certain diseases for which there is no record during service. This proposed amendment is necessary to implement a decision of the Secretary of Veterans Affairs under the authority granted by the Agent Orange Act of 1991 that there is a positive association between exposure to herbicides used in the Republic of Vietnam during the Vietnam era and the subsequent development of Type 2 diabetes. The intended effect of this proposed amendment is to establish presumptive service connection for that condition based on herbicide exposure.
