Commissioner Kelly's statement on regulations implementing the Energy Policy Act of 2005;
Coordinating the processing of Federal Authorizations for
applications under Sections 3 and 7 of the Natural Gas
Act and maintaining a complete consolidated record
- As I noted at the time we issued the NOPR in this proceeding, this rule recognizes a fundamental principle for making timely, thorough decisions involving multiple agency authorizations: "Everything done in parallel, not in sequence."
- Thanks to the thoughtful comments we received on the NOPR, revisions were made that I believe will lead to better, and more timely decisions, and without unduly burdening the states or agencies.
- The final rule also commits the Commission to coordinating with states, where possible, on the NEPA review. This means that we are ready, willing and able to work with those states that wish to coordinate with us. It is my hope that states take the opportunity to do so, as I believe it will facilitate this new process, and lead to better, more timely decisions.
- For all of these reasons, I am pleased to vote out this rule and I again thank staff for all their hard work in getting out this important EPAct provision in such a thorough and timely manner!
