Abstract This article describes some important points of law highlighted by four cases involving drink driving during 1992. In two cases the defendants were charged with failing to provide a specimen of breath for analysis. The wording of the charge which was considered sufficiently imprecise for the defendants to escape liability is discussed. In the third case the defendant was unwilling to provide breath samples because of his fear of AIDS. The court had to consider whether a phobia was a reasonable excuse for not providing a specimen. The fourth case involved the choice of specimen to be taken at a police station when the Intoximeter breath-testing device was faulty. The debate centered around whether the defendant should express his preference for the type of test undertaken.
