Richard (Rick) Miles, Director

On June 2, 2006, Rick was appointed Director, Office of Administrative Litigation; he will also continue to hold his previous position as Director of Dispute Resolution Service.

In 1999, Rick was appointed as the first Director of the Federal Energy Regulatory Commission's Dispute Resolution Service and the Commission's Dispute Resolution Specialist. Prior assignments at the Commission include: Associate General Counsel for Administrative Litigation (managed the Commission's division of trial attorneys representing the public interest in oil, gas, electric and hydroelectric evidentiary hearings -- 1988 - 1999); Assistant General Counsel for Electric and Corporate Regulation (managed the Office of the General Counsel's section of advisory attorneys responsible for drafting orders and rulemakings in electric and corporate matters --1986 - 1988); Supervisory trial attorney; and, Trial Attorney representing trial staff in hydroelectric proceedings before administrative law judges. In 1987, he was selected to be a member of the federal government's Senior Executive Service. Rick received his undergraduate and law degrees from the University of Baltimore.

As Director of Dispute Resolution, he has performed numerous ADR functions, including acting as a facilitator and mediator in many oil, gas, electric, pipeline and hydroelectric cases. Rick has received training in ADR from a number of sources, such as the introductory and advanced mediation courses and the negotiation course taught at Harvard's Program of Instruction for Lawyers, the "Teaching Negotiation in the Organization" course at Harvard Law School's Program on Negotiation, and the "Cultural and Gender Issues in Dispute Resolution" course taught at the Straus Institute, Pepperdine University School of Law.

Rick also appears on panels, conducts workshops discussing ADR and its use at the Commission, and conducts training in negotiation and mediation. Rick's efforts in this area have included workshops and presentations at a number of American Bar Association and Energy Bar Association functions, the Foreign Service Institute's Training Center, the Dominican Republic's Superintendencia de Electricidad, Canada's National Energy Board, the California Public Utility Commission, the Regulatory Commission of Alaska, the South Asia Regional Regulators meeting, the China Electricity Council, and other private and public organizations.

In April 2005, Rick ended his term as Chair of the Interagency Alternative Dispute Resolution Group Steering Committee. He is also currently Chair of one of the federal government's four ADR working groups - the Civil Enforcement and Regulatory Section. He is also a Vice-Chair of the ADR Division of the American Bar Association Environment and Energy Section. He recently was invited to be a member of the CPR Institute for Dispute Resolution.
