Summary

A firm protested a Department of Housing and Urban Development contract award for guard services, contending that the awardee did not intend to pay the applicable wage rates reflected in the Service Contract Act wage determination. GAO held that: (1) since the awardee did not show an intent to violate the Service Contract Act it was eligible for contract award; and (2) wage rate enforcement is not encompassed in GAO bid protest functions. Accordingly, the protest was dismissed.
