    Application for Commission Certification

    An application for Commission certification of QF status under 18 C.F.R. § 292.207(b) must include the following:

    • A cover letter that requests Commission certification of QF status and references the enclosures (Form No. 556, filing fee, draft Federal Register notice). If a docket number already exists for your facility, you should clearly identify it in the cover letter.

    • An original and 14 copies of a completed Form No. 556.

    • The public is given notice through an announcement in the Federal Register of the filing of applications for Commission certification. Thus, applications for Commission certification must be accompanied by a draft notice (visit our Notice Formats page) suitable for publication in the Federal Register. This draft notice should be submitted in electronic format on a 3 1/2" diskette or CD-ROM.

    • A check for the filing fee made payable to the Treasurer of the United States. Please visit our Filing Fees page for the most current filing fee. A filing date will not be assigned to an application unless it is accompanied by the proper fee.

    After submitting an application, applicants can locate documents related to their application and find their docket number by performing a New Dockets Search in eLibrary. Please refer to our Locating a Filing for QF Status in eLibrary page for more information. For facilities that have not been previously certified, a new docket number will be assigned. For facilities that are being recertified, the application will be assigned a new subdocket number within the existing docket number.

    Within 90 days of the filing of an application, the Commission will either inform the applicant that the filing is deficient, issue an order granting or denying the application, or act to postpone the date for issuing an order. Under 18 C.F.R., 292.207(b)(3), if the Commission has not acted upon the application within 90 days of the filing date, it shall be deemed granted.
