Trademark Daily XML Files - Weekly Status Report

The following is a status update for all inquiries.

*The format of the Weekly Status Report will appear as follows:
1. Each inquiry is given a USPTO Control # for tracking purposes.
2. The summary portion of “Status of Inquiries” will be “grouped” by the current status.
3. The detail portion of the report will be in sequence Control # (for easier reference).

"The U.S. Patent and Trademark Office is processing paper Madrid filings within a week of receipt and electronic applications within hours. Information is generally viewable on the USPTO website within 24 hours of the completion of Trademark processing. In addition to the work done on Madrid filings at the USPTO, there is also processing at the International Bureau of WIPO. Thus, in certain circumstances pendency is influenced by any backlogs that might develop at WIPO."

All Trademark Daily XML Files have been successfully disseminated through a new server since Tuesday, December 14, 2004.

NOTE #1: The Daily Application “B” file will be available through the file dated Thursday, March 31, 2005 and the March Monthly Status File will be available Tuesday, April 5, 2005.

Beginning April 1, 2005 the Daily Application “C” file will become the production file and the Daily Application “B” file, the Monthly Status file and accompanying Contractor’s Report will be discontinued.

NOTE #2: The following files will contain a <creation-datetime> field, with a format of yyyymmddhhmm, where yyyymmdd contains the year, month and day and hhmm contains the 2400 time in hour and minutes. The <creation-datetime> field identifies that each record present on the file is current up to the minute of extraction.

1. The Trademark Applications Retrospective File will contain all Live and Dead Trademarks through March 31, 2005.
2. The Daily Applications File as of April 1, 2005.
3. The Daily Assignment File as of April 1, 2005.
4. The Daily TTAB File as of April 1, 2005

NOTE 3: There will be a planned power outage at the USPTO Alexandria Campus Saturday, April 2, 2005 and Sunday, April 3,2005,

All Trademark Daily XML files dated March 31, 2005 will be available Friday morning, April 1, 2005. After that time no files will be available until Monday, 12:00 p.m., April 4, 2005.

On Monday, 12:00 p.m., April 4, 2005 the following files will be available:

1. The Trademark Applications Retrospective File containing all Live and Dead Trademarks through March 31, 2005. File(s) names to be provided.
2. The Daily Applications Files dated April 1, 2005, April 2, 2005 and April 3, 2005.
3. The Daily Assignment Files dated April 1, 2005, April 2, 2005 and April 3, 2005.
4. The Daily TTAB Files dated April 1, 2005, April 2, 2005 and April 3, 2005.
5. The Daily 24 Hour Box File and the Daily 24 Hour Box Supplemental file dated April 1, 2005.

Control #177

The <attorney-name> element is not present for all “C” records beginning the 1st of December 2004.

03/30/2005 – Applications that were missing the <attorney-name> element will be present on the Trademark Applications Retrospective File containing all Live and Dead Trademarks through March 31, 2005.

Control #202

The OG transactions being disseminated in the "C" file.

a. Contains transactions with a "10" (Principal Register) <action-key> but do not provide a <registration-date>.

b. The <status-code> for these registered transactions have not been updated and contain a "686" (Published for Opposition).

03/30/2005: This will be resolved by extracting all OG records each Tuesday night for dissemination each Wednesday morning.

Note: The skeleton/’placeholder of the records will be present on TARR the day prior to dissemination.

Control #206

In the apc050308 file and the apc050309 file there were 8,170 transactions with a <status-code> of "618" (Abandoned File - Backfile). Is this correct?

03/30/2005: This was a one time process to ensure that all "618" (Abandoned Files - Backfile) were in a proper location.

Control #207

The 25,750 of the Serial Numbers on apc-supp02.xml contain Serial Numbers with Series Code 77? An example being 77-377687 that is also present on TARR.

03/30/2005: These skeleton “77 series” applications should not have been present on the supplemental file and will not appear on the Trademark Applications Retrospective File.

Control #208

We still are receiving invalid first use dates or first international use dates. Sample Serial Numbers:

3/30/2005: A fix will be applied to correct all dates.

Control #209

Numerous virtually empty records are present on the “C” file. Below is a list of characteristics shared by most of these virtually empty records:

1. No '<Filing-Date>' tag present
2. Most contain a '<Status-Code>' = 630 (New Application - Not Assigned To An Examiner)
3. <Mark-Identification> = NULL or Space
4. <mark-drawing-code> = 1000 (MDC=1)
a. There should be no (Mark-drawing-code =1) for records filed after 11/02/2003.
b. (Mark-drawing-code = 1 and a <Mark-Identification> is a contradiction

3/30/2005: A 630 status-code without a filing date will no longer be extracted and placed on the “C” file.
