ORDER
OCCUPANCY AND USE
Pike and San Isabel National Forests
Cimarron and Comanche National Grasslands
Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited
within developed recreation sites, and other areas as described
in this order, shown on the attached maps, and located within the
Pike and San Isabel National Forests, until further notice.
(1). Possessing or leaving unattended any food, refuse or other
bear attractants
unless it is;
A. stored in a bear resistant method or,
B. being eaten, prepared for eating or being transported.

Pursuant to 36 CFR Sec. 261.5(e) the following persons are exempt
from the prohibitions contained in this order.
(1). Any Federal, State, or local officer, or member of an organized
rescue or fire
fighting force in the performance of an official duty; and
(2). Any person with a permit specifically authorizing the otherwise
prohibited act
or omission.

Violation of these prohibitions is punishable as a Class B misdemeanor,
by a fine of not more than $5,000 or imprisonment for not more than
six (6) months or both.
ORDER NO. 96-01
DEFINITIONS:
BEAR RESISTANT METHOD shall mean in a hard sided vehicle or camper,
approved bear resistant container or suspension at least 10’
above the ground and 4’ from any tree, post or other support.
BEAR RESISTANT CONTAINER shall mean s securable container constructed
of a solid, non-pliable material, and when secured or under stress
will not have any creaks, openings, or hinges that would allow a
bear to gain access by biting or clawing.
FOOD OR REFUSE shall mean any item for consumption, its container
or the refuse from preparation and consumption.
BEAR ATTRACTANTS shall mean any item that may attract bears such
as food, pet food, bird feeders, cooking utensils or other items
which have odors attractive to bears.
DEVELOPED RECREATION SITE includes any area which has been improved
or developed for recreation, 36 CFR 261. |
