ORDER
OCCUPANCY AND USE RESTRICTIONS
SAN ISABEL NATIONAL FOREST
Pursuant to Title 16, United States Code, Section
551, and 36 CFR, Section 261.50(a) and (b), the following acts are
prohibited on National Forest System lands within the Leadville
Ranger District of the San Isabel National Forest located in T.
12 S., R. 82 W., Section 8, 6th Principle Meridian, Chaffee County,
Colorado, hereinafter referred to as the Restricted Area.
The Restricted Area is locally known as the “Peekaboo
Site” and is depicted on the attached map, hereby incorporated
into this Order as Exhibit A. National Forest System Road (“NFSR”)
393.A, beginning 30 feet in from the junction of NFSR 393 and NFSR
393.A and ending at the road terminus, is also included in the Restricted
Area. The Restricted Area is closed to protect public health and
safety, and to prevent vandalism and looting.
PROHIBITION:
(1) Going into or being upon the Restricted Area (36
C.F.R. Section 261.53(c) and 261.53(e)).
(2) Using any motorized vehicle on NFSR 393.A, beginning 30 feet
in from the junction of NFSR 393 and NFSR 393.A and ending at the
road terminus. (36 C.F.R. Section 261.54(a)).
EXEMPTIONS:
Pursuant to 36 C.F.R. 261.50(e), the following persons
are exempt from the Order:
(1) Persons with a Forest Service permit specifically
authorizing the otherwise prohibited act or omission.
(2) Any Federal, State, or local officer, or member
of an organized rescue group or fire fighting force, in the performance
of an official duty.
(3) Persons owning the rights to the Leo Hatches Unpatented
Mining Claim, or any agents of same with written documentation in
their possession, executed by the unpatented claim owner, authorizing
the otherwise prohibited act or omission.
This Order is in effect for two (2) years from the
date signed, or until rescinded, whichever event occurs first.

Violations of these prohibitions are punishable as
a Class B misdemeanor by a fine of not more than $5,000 for an individual
or $10,000 for an organization, or imprisonment for not more than
6 months, or both. (16 U.S.C.§ 551 and 18 U.S.C. §§
3559 and 3571).
