On March 30, 2007, the U.S. District Court for the Northern District of California issued an injunction that ordered the Forest Service to discontinue use of the 2005 planning rule to amend or revise land management plans. On August 23, 2007, the Forest Service published in the Federal Register a proposed rule and draft environmental impact statement (draft EIS) to comply with the deficiencies that the District Court found with the 2005 planning rule.

2008 NFMA PLANNING RULE

The Final Environmental Impact Statement (FEIS) for the 2008 Planning Rule has been released. The FEIS identifies the Forest Service’s preferred alternative and is a procedural move towards the implementation of a new planning rule. A decision on the final rule has not been made—that decision will be made by the Department of Agriculture after the FEIS has been available for 30 days.( News Release | FEIS)

Background

The National Forest Management Act (NFMA) requires every national forest to prepare a management plan for the lands and resources contained within it. Periodically these plans need to be updated. The Tonto National Forest has embarked on the process to update its plan.
