SUBJECT: 1998 Agency Ethics Program Questionnaire


1998 Questionnaire Due February 1, 1999

Please complete and return the attached 1998 Agency Ethics Program Questionnaire to the Office of Government Ethics (OGE) no later than February 1, 1999. Your response to this questionnaire will constitute your annual report as required by section 402(e)(1) of the Ethics in Government Act of 1978, as amended.

The questionnaire covers the period January 1, 1998 through December 31, 1998. Failure to file on or before February 1, 1999, may be cause for OGE to invoke its corrective action authority (5 C.F.R. § 2638.602(b)). Please note the information contained in the questionnaire is subject to the Freedom of Information Act.

New Reporting Format for This Year's Education and Training Statistics

As you know, the interim rule amendments to the training regulation changed how annual training is to be presented to certain "covered" employees. It also changed some of the exceptions. (See March 20, 1997, DAEOgram Publication of Interim Rule Amendments to the Training Regulation, DO-97-013.)

As a result, revisions have been made to the 1998 questionnaire to account for these changes. A new question 3 replaces former questions 3 through 7. These revisions were announced in the distribution DAEOgram for the 1997 Annual Agency Ethics Program Questionnaire. (See October 31, 1997, DAEOgram, DO-97-033.)

In addition, under the Ethics Opinions, Advice and Counseling Section, questions referencing the Procurement Integrity rules have been dropped. Specifically, question 1 has been modified and former question 2 has been removed. In addition, OGE has clarified the definition of special Government employee in footnote 5 on page 15 and made various minor style and format edits throughout the questionnaire. Since these changes did not require additional data collection on the part of the agencies, advance notification was not necessary.
