The FY 2009 Priority List consists of 55 total projects related to State and Tribal Government cemetery construction grant applications.  The State Government projects are subject to the regulatory provisions of 38 ยง CFR 39.7.  Tribal Government projects are subject to the statutory provisions of Section 403 of Public Law 109-461.  The current estimated value of the projects is approximately $210 million.  Included on the FY 2009 Priority List are 8 pending grant awards (noted w/ *) that were approved after August 15, 2008.  There are 34 ranked projects where the States or tribal Governments have certified as meeting the requirement for certification of State or tribal Government matching architectural and engineering (A&E) funds for Group 1 status.  Those A&E funds are necessary to fully develop a proposed project in a timely manner.  The State or tribal Government will be reimbursed for all allowable A&E expenses associated with the project, following the grant award.  The current estimated value of the 34 projects is approximately $151 million. 

In this group are the first two pre-applications from a tribal Government, Pascua Yaqui Tribe and Rosebud Sioux Tribe, and are ranked numbers 22 and 23, respectively.  Additionally, there are 21 ranked projects in Group 2, where the States or tribal Governments have not met the requirement for certification of State or tribal Government matching architectural and engineering (A&E) funds.  Included in Group 2 are 5 additional tribal Government pre-applications.  The estimated value of the Group 2 projects is approximately $59 million, which are not eligible for funding consideration in FY 2009.
