A Guide to Sentencing DUI Offenders |
This sentencing guide is designed to assist judges and prosecutors in reducing recidivism among people convicted of drinking and driving offenses (known as driving under the influence [DUI] or driving while intoxicated [DWI]). It provides information for judges and prosecutors in matching offenders to the most effective combinations of sanctions and treatment to protect the public from drinking drivers. In addition to an extensive reference section, the guide includes four main sections: Sentencing, Specific Sanctions and Remedies, Rehabilitation Options for Offenders and Sentenced Treatment, and Compliance and Reporting. The guide was developed by the National Highway Traffic Safety Administration (NHTSA) and the National Institute on Alcohol Abuse and Alcoholism (NIAAA) in conjunction with an interdisciplinary working group of judges, prosecutors, and researchers.
