Title 42, Senior, Executive, & Scientific Rates
Dr. Zerhouni recently approved a number of recommendations made by the NIH Steering Committee (composed of representatives of the NIH intramural, extramural, senior administrative, and human resources communities) related to NIH implementation of the Department's new Title 42 (f) policy. The following documents describe the NIH implementation of the DHHS Policy Guidelines on the use of Title 42 (f):
- Memorandum to IC Directors from Dr. Zerhouni, "Implementation of New Title 42(f) Policy Requirements (.pdf), " dated May 16, 2005
- Memorandum to Deputy Director, NIH, and IC Directors from Dr. Zerhouni, "Delegation of Personnel Authority - Performance Based Pay Adjustments for Scientists Appointed under Title 42(f) (.pdf)," dated May 16, 2005
- Memorandum to Operating and Staff Division Heads from Ed Sontag, "Departmental Policy on Use of Title 42 Authority (.pdf), " dated August 5, 2004, with attachment - "HHS Personnel Instruction 42-1 Appointment of 42 USC 209 (f) Scientists"
- Title 42 Pay Model Guidance for Spring Increases (.doc)
- Title 42 Employment & Compensation 2005 Memo - Discontinuance of Cost-of-Living Increase for Title 42 (f) Employees (.pdf)
This memo states:
"In previous years, at the discretion of the Director, NIH, comparability pay increases (frequently referred to as cost-of-living or COLA increases) for all Title 42 employees have been approved around this time of year. While Title 42 (g) employees will continue to receive COLAs at the Director’s discretion, the new DHHS policy prohibits COLAs for Title 42 (f) employees. Yearly pay increases for Title 42 (f) employees will be performance-based, will be consistent with the employee’s annual performance appraisal, and will be limited to one increase per year that will range from 0 to 6 percent. Furthermore, DHHS expects that not all Title 42 (f) scientists will receive a 6 percent increase but, rather, that increases will be granted in varying amounts reflective of distinctions in performance. While the departmental policy grants the NIH Director authority to approve higher increases on an individual basis where performance clearly warrants, DHHS expects such exceptions to be rare and to be fully documented and justified." - Title 42 Pay Model
