Use the information found in salary surveys as guidelines from which to begin your negotiations, not as hard and fast rules as to what you are worth. If you do not see your specialty listed here, check the professional association that represents you. They usually have this kind of information available to members. Employment Contracts for Physicians
  • Contracts, What You Need to Know, AMA Young Physicians Section. Offers practical tips on contracting issues along with advice.
  • Anatomy of a Physician Employment Contract by Bonnie Darves (NEJM September 2002). A basic understanding of the main elements of employment contracts will help you wade through what is often a multipage document replete with legalese.
  • Avoiding Physician-Employment-Contract Pitfalls by Bonnie Darves (NEJM, September 2002). Because the “devil is in the details,” it’s imperative to thoroughly review the contract (with professional guidance, if necessary) to ensure it doesn’t contain — or leave out — provisions that could turn the perfect opportunity into a bad deal.
  • Physician Compensation Models: The Basics, the Pros, and the Cons. (NEJM, September 2004) "Consideration and understanding of the intricacies of the specific compensation model offered by the prospective employer is crucial. Even more important is whether a job is one the physician truly feels will contribute to his or her professional development and provide satisfaction and enjoyment.”
  • Restrictive Covenants, AMA Office of General Counsel. This article provides information on restrictive covenants, a contractual provision between a physician and his or her employer which prevents the physician from practicing in a specified geographic area for a given period of time if the physician's employment terminates. Another term for "Restrictive Convenant" is "NonCompete Agreement", so you may want to read our additional information on this topic, below.
  • Annotated Model Physician Employment Agreement. The AMA Office of General Counsel has developed this resource for physicians who want to be better prepared to negotiate an employment contract. While the original document is from December 2003, it was recently updated (2005).
