Complaints Filed by an NIH Federal Employee Who is Covered by the Bargaining Unit

Some of NIH's unions provide a grievance process for discrimination issues. If you are a member of an NIH union, you may elect to file a discrimination complaint through the union. However, at the formal process, you cannot file both a union grievance and a formal EEO complaint on the same issue. Time frames for filing union grievances are different from those for pursuing EEO complaints. If you are considering the option of filing a grievance with your union, please check with your union steward.

Complaints Filed by An NIH Employee And A Member Of The Commissioned Corps Of The Public Health Service

Discrimination complaints processing is available for officers of, and applicants to, the Commissioned Corps of the Public Health Service. Members of the Public Health Service (PHS) Commissioned Corps who are assigned or detailed to another Agency or organization may only file a complaint under the procedures specified in INSTRUCTION 6, Sub-Chapter CC26.1 of the CCPM when the subject of the complaint is a matter under the control of the Department of Health and Human Services (DHHS). If You Are A Contractor Working For NIH And Have Experienced Discrimination

The Federal EEO process does not apply to contractors. If you are a contractor, you should contact your company for procedures on filing an EEO complaint against your company. However, in some situations, if you believe you have been discriminated against by NIH management, you may contact the OEODM for procedural guidance. The OEODM staff will analyze the information and provide you different avenues to address your problem. You may also contact Montgomery County's Maryland Office of Human Rights for advice.
