(a)(1) The student is liable for any Federal Pell Grant overpayment made to him or her. (2) The institution is liable for any overpayment if the overpayment occurred because the institution failed to follow the procedures set forth in this part. The institution shall restore those funds to its Federal Pell Grant account even if it cannot collect the overpayment from the student. (b) If an institution makes an overpayment for which it is not liable, it shall help the Secretary recover the overpayment by-- (1) Making a reasonable effort to contact the student and recover the overpayment; and, if unsuccessful, (2) Providing the Secretary with the student's name, social security number, amount of overpayment, and other relevant information. (c) If an institution refers a student who received an overpayment for which it is not liable to the Secretary for recovery, the student remains ineligible for further title IV, HEA program assistance for attendance at any institution until the student repays the overpayment or the Secretary determines the overpayment has been resolved.
