On November 30, 2007, the Huntington, West Virginia Police Department issued a warrant for Peterson charging him with First Degree Murder and First Degree Robbery. Investigation led SOFAST to a possible employment work-site located at 659 Lakeview Place Worthington, Ohio. Upon arrival, Peterson was spotted at the location and after a brief foot chase he was apprehended without further incident.

Peterson is currently incarcerated at the Franklin County Jail awaiting extradition back to Huntington, West Virginia.
