Analysis Regarding The Food and Drug Administration's 
Jurisdiction Over Nicotine-Containing Cigarettes and Smokeless Tobacco 
Products; Correction

AGENCY: Food and Drug Administration, HHS.

ACTION: Notice; analysis regarding agency jurisdiction; correction.

SUMMARY: The Food and Drug Administration (FDA) is correcting a notice 
that appeared in the Federal Register of August 11, 1995 (60 FR 41453). 
In the notice, FDA published a document entitled ``Nicotine In 
Cigarettes And Smokeless Tobacco Products Is A Drug And These Products 
Are Nicotine Delivery Devices Under the Federal Food, Drug, and 
Cosmetic Act,'' and announced the availability of appendices to this 
document. The agency has identified some proofreading inaccuracies in 
the references listed in the document. This document corrects those 
errors.

    3. On page 41558, in footnote 93, in line 4, ``Parmacol. Biochem.

    4. On page 41560, in footnote 101, in line 4, ``Page 50'' is 
corrected to read ``Pages 50-51.''
    5. On page 41561, in footnote 105, in line 2, ``231-234'' is

    6. On page 41588, in footnote 172, in line 8, ``12641-46'' is
