In 2006, CMS made available a new Medicare demonstration project under the authority of section 402 of the Social Security Amendments of 1967, as amended. Our goal was to ensure that the Medicare and Medicaid programs could respond expeditiously to the needs of the dual eligible beneficiaries and beneficiaries who enrolled in a Part D plan and were determined to be eligible for the low-income subsidy. This demonstration allowed States that assisted their dual eligible and low-income subsidy entitled populations in obtaining and accessing Medicare Part D coverage to be reimbursed for their efforts. The following information was used in the demonstration process. {2}State Medicaid/SPAP Director's Letter and {3}402 Demonstration Template Please find under "Downloads" a State Medicaid and SPAP Director's letter describing the demonstration in further detail, along with a template that States may use to apply for this section 402 demonstration. {1}State Reimbursement for Medicare Part D Transition Fact Sheet This state reimbursement plan enables States to be fully reimbursed for their efforts to help ensure that their beneficiaries eligible for Medicare and Medicaid have access to their covered Medicare drugs as they move to their new Medicare Part D drug coverage. The plan also supports limiting the need for State reimbursement by supporting the use of Medicare payment systems whenever possible, and promotes the effective transition of dually eligible Medicare beneficiaries into their new Medicare coverage.
