Provisions of the Permanent Appropriations Repeal Act

A-58219 December 16, 1935

Summary

The Department of the Interior asked GAO for its opinion on the provisions of Section 20 of the Permanent Appropriations Repeal Act, which directs that moneys received by the Government as trustee analogous to certain funds listed therein shall be deposited into the Treasury as trust funds with appropriate title. Specifically, Interior asked whether the act applies to individual Indian money.

GAO found that such funds should be deposited into the Treasury as trust funds with appropriate title, all amounts credited thereto being automatically appropriated and made available for disbursement in compliance with the terms of the trust, that is, for the purpose for which individual Indian money may be expended.
