PROGRAM INSTRUCTION

TO:   State Administrators of State Public Welfare Agencies, Titles IV-B and IV-E of the Social Security Act.

SUBJECT:   Placements Pursuant to Voluntary Placement Agreements

LEGAL AND RELATED REFERENCES:   Public Law 98-118 (Federal Supplemental Compensation Act of 1982), Section 3; Public Law 96-272 (The Adoption Assistance and Child Welfare Act of 1980), Section 102(a)(1) and 102(c); Sections 427(b) and 472(d) of the Social Security Act (the Act).

INSTRUCTION:   Section 3 of P.L. 98-118 amends section 102(a)(1) and 102(c) of P.L. 96-272 and extends the expiration date permitting Federal funds to reimburse the State for dependent children placed in foster care pursuant to voluntary placement agreements from October 1, 1983 to October 1, 1984. States wishing to claim FFP for children placed in foster care pursuant to a voluntary placement agreement must:

  1. have in effect a title IV-E State Plan which contains the necessary provisions as described in ACYF-PI-81-2, March 23, 1981.
  2. certify that they are meeting the requirements of section 427(b) of the Act, actually be meeting the requirements, and, if they have been reviewed for section 427(b) eligibility, have been found eligible for the year for which claims are made.
  3. meet the requirements of section 472(d) of the Act.

EFFECTIVE DATE:   October 1, 1983.
