The Office of Child Support EnforcementGiving Hope and Support to America's Children

Welfare Reform Resource Personel

December 6, 1996 DCL-96-71

TO ALL STATE IV-D DIRECTORS

RE: Public Law 104-193 Resource Persons

Dear Colleague:

Attached is a draft Information Memorandum that compiles lists of resource persons who may be helpful in implementing the various child support enforcement provisions in the 1996 welfare reform legislation (Public Law 104-193).

The Explanatory Note on pages 2 and 3 of the attached draft Information Memorandum provides a full description of how and why these lists of resource persons are now being assembled.

We are distributing the attached draft Information Memorandum at this time as a Dear Colleague Letter for several reasons. First, we want to make it as clear as possible that State IV-D Directors are welcome to submit the names of additional resource persons that they believe should be added to the lists. Second, to follow up on the New Responsibilities Forums in a timely manner, we did not want to delay sharing with the States the lists of experts we already have. Third, based on the feedback we receive to this Dear Colleague Letter, we intend to publish a revised, expanded, and bound edition of these resource persons lists next spring which will also be made available to the public as part of the OCSE Home Page on the Internet.

We see this "specialized rolodex" as an evolving document that will be revised and redistributed from time to time. If you have any questions, please contact Duke Wilson at (202) 260-5981.

Sincerely,

David Gray Ross

DRAFT INFORMATION MEMORANDUM:

LISTS OF

CHILD SUPPORT ENFORCEMENT

RESOURCE PERSONS

Office of Child Support Enforcement

Division of State and Local Assistance

Technical Assistance Branch

December 6, 1996

EXPLANATORY NOTE

The purpose of this Information Memorandum is to disseminate lists of resource persons who may be helpful in implementing the various child support enforcement provisions in the 1996 welfare reform legislation (Public Law 104-193). The welfare reform legislation, The Personal Responsibility and Work Opportunity Reconciliation Act of 1996, amended many parts of the child support enforcement laws. These changes in the law raise a number of important questions for child support agencies. Many of these questions remain to be answered. Think of these lists as a specialized rolodex intended to support a dialogue on welfare reform implementation issues in the child support enforcement community.

A good place to start for many readers is with the Federal child support enforcement staff in the Regional Offices, who are listed separately and first. These persons are knowledgeable about the Federal law, the State laws in their region, and the recent changes in these Federal and State laws. The other attached lists are organized using the child support enforcement provisions in the new welfare reform law. These lists provide the names, mailing and/or electronic addresses, and telephone numbers of persons readers may contact in order to gain additional information and insights.

Readers are encouraged to call these persons. The persons on these lists have been identified as knowledgeable about the Child Support Enforcement program and some aspects of the recently enacted welfare reform legislation. These persons are prepared to informally share some of their knowledge with you. The attached lists are not an exhaustive survey of persons who can be of help. The lists simply share the names of some persons who are prepared to discuss their ideas and opinions. Be advised these lists will be updated continually and re-issued regularly. To ensure a variety of perspectives and to respond to the diverse needs of the persons charged with implementing the new law, the lists tend to mix the names of Federal central office and regional office staff with State staff and, in some instances, with persons from the not-for-profit private sector.

In the area of technical assistance, OCSE is striving to create an environment that encourages and rewards creativity throughout the Child Support Enforcement program. Toward these ends, these lists will be updated on a periodic basis to incorporate the names of other resource persons and will also be included in future editions of OCSE's Resource Directory. If you know other resource persons who are able and willing to be included on future lists, please contact your ACF/OCSE Regional Office. You may also contact:

Section 325. State Laws Providing Expedited Procedures. State IV-D programs are granted the authority to take action "without the necessity of obtaining an order from any other judicial or administrative tribunal, but subject to due process safeguards as appropriate." These actions include ordering genetic testing for paternity establishment, issuing a subpoena for financial or other information, and requiring all entities to respond to requests for information. States are granted access to public records such as vital statistics of marriage birth and divorce, state and local tax records, real and titled personal property, license records, employment security records, public assistance programs, motor vehicle records and corrections records. Also grants access to certain private records such as public utility and cable television records and financial institution data. Other administrative measures include the power to change the payee to the state, to order income withholding and to seize assets to satisfy arrearages and to increase the amount of the award to pay arrearages. Automation must be used as a means of implementing the expedited administrative procedures.
