RE: States' Implementation Status of the Uniform Interstate Family Support Act

Dear Colleague:

Enclosed is an updated matrix of States' implementation status for the Uniform Interstate Family Support Act (UIFSA). This matrix illustrates a national overview of all 54 states' and jurisdictions' legislative and implementation status. The matrix contains basic UIFSA implementation data of interest to States. This information includes States' enacted date, implementation date, state contact/number, code cited, adopted verbatim, etc.

To date, 46 States (District of Columbia included) have adopted the Act and 38 States have started implementation. States with legislation pending are: Connecticut, Georgia, Guam, Kentucky, New Jersey, Nevada, Puerto Rico, and Virgin Islands. As a requirement of the Personal Work and Responsibility Reconciliation Act of 1996 and effective January 1, 1998, all States are required to adopt this Act.

19. Kentucky: Failed to get UIFSA enacted in its last legislative session. They plan to propose UIFSA in the '96 session.

UIFSA legislation passed but it will "ONLY BE EFFECTIVE" if we require States to implement UIFSA laws.

STATUS UPDATE: Kentucky has problems with their legislation. The legislation has to be resubmitted, therefore, KY will not be able to start UIFSA. The KY statute had a provision that stated that when Congress mandated UIFSA, then KY could implement the provision. The chief statute writer for the legislature said that Congress simply stated that the State should implement UIFSA or lose money. KY has a choice, therefore, KY plans to take out the part that mentions enacted if mandated by Congress and to add any updates. KY plans to go ahead with the training of staff but will not be considered an UIFSA state.

31. New JerseyHas legislation (A-1337) pending in the State Assembly. The bill, as written, mirrors the model legislation in its entirety. As an aside, NJ is being very cautious in enacting this legislation, preferring to wait until Congress passes welfare reform legislation to see if there will be a mandate for States to adopt UIFSA and/or to see if there will be any substantive changes in the model law. As a result, this bill has been in the State Assembly since 9/94).

Status Update: The UIFSA proposal is now pending the introduction of the legislative proposals needed to bring the IV-D program into compliance with the PRWORA, and is expected to be introduced in the State legislature this Fall.

Update: Will repeal URESA. Completed PRWORA legislation which includes all UIFSA and UIFSA language verbatim (Spanish will introduce a Spanish/English version, with the English prevailing in the event of translation ambiguities. Legislation is undergoing final review in Governor's office. While introduction date and legislative hearing dates not yet set, Region II was assured by Governor's legal staff on October 2 that legislation will be introduced and passed before session ends this year.
