ACTION TRANSMITTAL

TO: STATE AGENCIES ADMINISTERING CHILD SUPPORT ENFORCEMENT PLANS APPROVED UNDER TITLE IV-D OF THE SOCIAL SECURITY ACT AND OTHER INTERESTED INDIVIDUALS

SUBJECT: Revisions to the Title IV-D State Plan Preprint and Submission of State Plan Page to Indicate Compliance with Federal Requirements for State Directory of New Hires

ATTACHMENT: Attached is a new and revised title IV-D State plan preprint page 3.15 reflecting the changes made to the State plan provisions of title IV-D of the Social Security Act by P.L. 104-193, the Personal Responsibility and Work Opportunity Reconciliation Act of 1996.

The attachment consists of the following State plan preprint page:

o Section 3.15, State Directory of New Hires, is added which specifies that: 1) States, which did not have a new hire reporting law in existence as of August 22, 1996, operate a State Directory of New Hires in accordance with 167453A effective October 1,1997; or, 2) States, which did have a new hire reporting law in existence as of August 22, 1996, will meet the requirements of 167453A(g)(2) effective October 1, 1997, and will operate a State Directory of New Hires in accordance with 167453A effective October 1, 1998.

APPROVAL OF STATE PLAN

States must submit this page no later than December 31, 1997, along with a completed transmittal notice form (OCSE-21-U4) to the appropriate ACF Regional Administrator attesting to compliance with the requirements set forth on the page. States must attest to all the October 1, 1997 requirements no later than December 31, 1997. If States have a new hire reporting law in existence as of August 22, 1996, they must send in an amended preprint page attesting to operating a State Directory of New Hires in accordance with 167453A no later than December 31,1998.

ACTION REQUIRED: Submit this page no later than December 31, 1997. (In cases where legislation is needed, States must submit this page before the end of the first calendar quarter beginning after the close of the first regular State legislative session that begins after August 22, 1996. In the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature).

o Effective October 1, 1997, meets the requirements of 167453A(g)(2);

and

[ ] Effective October 1, 1998, operates a State Directory of New Hires in accordance with 167453A.
