Architecture, Design, And Engineering (ADE) Drawings

Rights and Restrictions Information

Prints and Photographs Division, Library of Congress, Washington, D.C., 20540-4730

Drawings in the Architecture, Design, and Engineering drawing collection (ADE 11 and ADE
UNITS) may be restricted.

Access: Permitted; subject to P&P policy on serving originals, which requires the use of digital
surrogates in lieu of originals, when available.

Reproduction (photocopying, hand-held camera copying, photoduplication and other forms of copying allowed by "fair use"): Permitted: subject to P&P policy on copying which prohibits
xeroxing of original drawings.

Publication and other forms of distribution: May be restricted.

Patrons wishing to publish or otherwise distribute items from this collection must conduct item-
specific assessments of the rights which may be associated with the specific pieces. Rights will
vary depending on such factors as whether the work was published, whether it was unpublished
(created for purposes other than distribution), or whether it was created for a client as a "work for
hire." The Division's reference aid, "General Information about Copyright and Other
Restrictions Which Apply to Publication and Other Forms of Distribution of Images: Sources for
Information," (http://www.loc.gov/rr/print/195_copr.html) may be of assistance in determining the appropriate use of an ADE drawing.

All information documented by P&P staff regarding publication and/or copyright claimants has
been recorded in the catalog record. To the extent known by the Library, the addresses of such
parties and an indication of the status of their works are listed under the person's or firms' name in the Rights and Restrictions Information page found online on the Prints and Photographs Reading Room homepage (http://www.loc.gov/rr/print/) .

However, many drawings lack sufficient information to determine copyright status. Patrons
who wish to show that a reasonable effort was made to determine copyright status may wish to
request a copyright search using whatever information can be gleaned from the catalog record
and retain any supplied report for their records.

When explicit rights information is lacking, patrons must conduct a "risk analysis" to determine
appropriate use of an image. This involves coupling a knowledge of rights principles (such as
duration of copyright, and the definition of "published" works) with the risk associated with the
intended use (i.e. educational or commercial) and then making and documenting for your records
the basis for your decision to use the piece.
