RE: Legislation Allowing State Workforce Agency Access to National Directory of New Hires
Dear Colleague:
Recent Federal legislation, P.L. 108-295, known as the “SUTA Dumping Prevention Act of 2004”, adds a new use for data maintained in the National Directory of New Hires (NDNH). Section 3 of that Act amends section 453 of the Social Security Act to require a new information comparison involving the NDNH. Under this provision, state agencies responsible for the administration of Unemployment Compensation programs under Federal or state law will match information in their records with information in the NDNH. The information resulting from the match may be used only for purposes of administering such programs. The term “SUTA” stands for State Unemployment Tax Act, and the first part of the bill refers to prevention of unemployment tax avoidance.
I have enclosed a copy of this new provision for your information. A workgroup meeting with representatives from the State Workforce Agencies met on November 9th to discuss implementation of this provision.
