Ohio Department of Public Welfare, DAB No. 545 (1984)

GAB Decision 545
Docket No. 84-86

June 14, 1984

Ohio Department of Public Welfare;
Ford, Cecilia Sparks; Garrett, Donald Settle, Norval

The Ohio Department of Public Welfare appealed a decision by the
Health Care Financing Administration disallowing $916,119, in federal
financial participation claimed by the State under Title XIX of the
Social Security Act for the quarters ended March 31, 1983 and June 30,
1983. The State's claims were for inpatient psychiatric services
provided by State institutions for mental diseases (IMDs) to Medicaid
patients aged 22 to 64 during the months the patients were admitted to
the institutions.

The issues are those addressed by the Board in Joint Consideration:
IMD Admission/Discharge Issue, Decision No. 436, May 31, 1983, and Ohio
Department of Public Welfare, Decision No. 486, December 13, 1983. The
parties agreed that separate proceedings in this case were unnecessary
and that the Board should proceed to decision based on the parties'
presentations in the previous cases. Accordingly, for the reasons
stated in Decision Nos. 436 and 486, which are incorporated here by
reference, we uphold this $917,119 disallowance, subject to reduction
under the conditions stated in Decision No. 436.
