The Pennsylvania Department of Public Welfare appealed a decision by
the Health Care Financing Administration disallowing $3,389,239 in
federal financial participation claimed by the State under Title XIX of
the Social Security Act. The claim, included on the State's expenditure
report for the quarter ending March 31, 1983, was for inpatient
psychiatric services provided to individuals between the ages of 22 and
64 during the month the individual was admitted to or discharged from an
institution for mental diseases, or during the month after the month of
admission.

Upon receiving the notice of appeal, the Board consulted with the
parties about how to proceed since it appeared that this appeal involved
issues previously decided by the Board in Joint Consideration: IMD
Admission/Discharge Issue, Decision No. 436, May 31, 1983. The
appellant confirmed that this appeal raised no new issues and agreed
that the Board should proceed to decision based on the presentations in
the previous case. The respondent did not object to this procedure.

Accordingly, for the reasons stated in Decision No. 436, which is
incorporated here by reference, we uphold this disallowance of
$3,389,239. The disallowance is subject to reduction under the same
conditions as the disallowances in Decision No. 436.
